You know Andrea Lyon said the same thing as she left. Think we'll ever see her again? (Wouldn't they have to have the court's permission to pop back on the case?)

Kenney Baden goes on to say she cannot continue representing Casey Anthony "in the absence of substantial funds to cover the costs of travel and reimbursement for expenses, which she anticipates will increase as trial approaches…"

Conveniently enough.......this was not a problem during the time that her book "Skeleton Justice" was released.....June 2009!!!!

I also find curious, her use of the word "substantial" when referring to funds. She could have used the word adequate, appropriate or standard. "Substantial implies a "windfall" or a "moneymaker".

oops.....

What I would find hilarious (well maybe just telling)....is if the JAC agreed to "consider" payments to her provided they received a full accounting of all monies paid and any agreements signed. Think anything would change?????? Bueller???? Bueller???????

I think LKB could have resigned for all the reasons stated above.

One other possibility is that she thought she would be getting more money with all her padded expenditures and future earnings in the long run and she could still be able to brag about working pro bono to make herself look good. When she realized how closely the JAC was checking and limiting amounts paid out, she knew it wouldn't be a gravy train after all.

I had Garcia in yellow and noted that he was in hiding due to Casey's flirtation with him until I was told he's gone !

Sleuther, it struck me as very odd too ... I didn't know whether to think does she mean it would take substantial funds to pay her 1st class travel and 5 Star accommodations? Or did she mean, it would take a lot of money, or promise of a lot of money to hold my interest? ... or maybe she was saying the state of FL doesn't have enough money to keep me on this loser of a case?

Anyway, you look at it ... strange choice of words indeed ...

It was news to me too ... my first thought was the jailhouse letters probably freaked him out and sent him running ... before he became the subject of an investigation or KC made any accusations about him ...

I take no issue with anyone eligible to jump ship doing just that. What annoys me...the reasons given that just don't make sense.

It's kind of like a divorce citing "irreconcilable differences"...when it really means he was an a$$hole and I couldn't run fast enough.

I understand that it is important to protect KC's right to a fair trial. As a FL. resident.....I want her to have a fair trial!!!!! If LKB were to say anything prejudicial it would create an appellate issue. BUT....waiting this long AFTER the initial declaration of indigency and JAC rulings before formally withdrawing...just doesn't wash...and reeks of a deficit in professional ethics.

How do all these people on her team who managed to pass the bar exam claim to believe her innocence, but lots of other people can see right through her story? Is it because they have privileged inside information? If so, why don't they just tell the world so she can go free? Or, wait, are they just full of bologna?
As you know, the attorneys are lying, in exchange for money, while they look for loopholes and grasp at straws, in exchange for money. Happens all the time. It's the main thing that led me to lose faith in the judicial system. And it surprises me that I haven't been able to find a forum or discussion on here that's devoted to the ethics of attorneys, judges, and police officers.

BBM - Yep. And not only that, but before she was declared indigent, what 'substantial' funds did LKB think Casey had? By saying she's leaving the case because she lives in NY and the trial's in FL and nobody will pay her way, is just a dumb lie. Because nobody was gonna pay her way to begin with. It's just so plain and clear, and please defense team, stop calling the public stupid right to our faces, ok? Thanks. And have a nice day.

One of the most important things to remember in all of this and beyond the KC case is that the legal system is not perfect.

Loopholes do exit and while used at times to free guilty people...they are there there for innocent parties as well.

I think that trying to discuss the ethics of any group at large such as LE, Attorney, Judge, etc....is far too broad a task. At the end of a day, while politics do factor into a case....the professional ethics of individuals are what guide and /or lead a case.

Having Judges, Attorney's, and LE in my family...as well having social relationships with all the same groups...I can tell you that one simply CAN NOT categorize or assign ethics beyond an individual.

Whether folks like it or not...any person accused and charged with a crime is entitled to representation. There will be times where someone "gets off" on a technicality. But that technicality is available for use by innocent parties as well as guilty parties.

The legal system is available for everyone. While it may have flaws, it is not fatally flawed. We must recognize that it is ever changing and evolving. That is why it is so important for those in LE, and beyond to be up to date on changes and practices.

IMO we are seeing the KC case in a vacuum. There is passion and opinion that runs strong. While I am disgusted by some of the things I have read about this case...I have no choice but to remind myself that the system must be allowed to work.

.... a defense attorney said once...his job was to force the system to work precisely by the rules.

The New York City based attorney cited financial reasons for her departure and state rules surrounding Casey Anthony being declared indigent for costs in the murder case.

She noted that the defense team must comply with Justice Administration Commission rules in this case.

"As out of state counsel I have been traveling to Florida and elsewhere to properly represent Ms. Anthony," she wrote in her motion. But, she added, it is her "understanding that the JAC prohibits payment of such costs to out of state attorneys even though they have rendered and are rendering their services free of charge."

If she can't afford the cost of her flying around, what makes her think the State can afford it?

Which is exactly why the state wants a local to do it, instead of paying someone from out of state, that would have to travel to the state, to do the job.. like DUH!

Her payment was the exposure she got for her book.

LKB knew the day that ICA was declared indigent about the issue with travel and expenses so it is no surprise. LKB continued to work on the case under the new rules.

To me, this is more about recent developments and a need for a graceful exit before the Defense ship sinks. I would think you'd want to distance yourself, for credibility reasons -- if you knew there was some truth to the witness tampering and risk tactics.

LKB has already reaped the rewards of being on the ICA case and so it is now time to cut her losses.

bbm. This one gets my FIRST vote, but ALL of the above choices work too!

"Bear in mind" (props to HHJP), Ms. Baden has a reputation she wants to uphold. She's had her "questionable moments" in court, but overall this is one very sharp, educated lawyer. She LOVES to nail experts in forensic cross examination. She LOVES to "get 'em", so to speak. When there are indeed "holes" in evidence/testimony, etc. she pounces like a tiger. I have seen her during a trial (many moons ago) and she was ON IT. Impressive stuff. This case is different, though. I just could not imagine her intellectually pouncing on the forensics here. JMO, but I think she couldn't find a weak toehold and she couldn't find evidence of contamination. There was no "meat on the bone" for her. Off to greener pastures (?) and another not-as-lopsided case. Plus, you can't put a pricetag on a professional reputation in this arena. When it's POOF, it's really POOF.

JMO....

Plus ... LKB was sorta/kinda replaced by the recent local new hires into the team. They are going to argue brass tacks and not major Baden team revelations.
