What?? The appointment was for JR that was missed the day of December 27th not Haleigh. The court date was not even determined until December 12th based on a motion for a rehearing that Crystal requested. I know maybe RC has an in with the DR and it was a huge conspiracy and the Drs office coordinated with the courts to make sure the appointment was the same day, what I can't figure out is how the Drs office, the court, and RC all worked together and made Crystal decide not to bring JR back early so she could take him to the Dr herself or RC could take him to the Dr. GMAB

If, as you contend, there is no conspiracy, that Ronald, the custodial parent, the man who knew in advance (say, like after Jr's last dr visit when he was handed a card like most offices give out for followup appointments), didn't let Crystal know until the day BEFORE an 8:30 appt when she has to also appear in court at 10:41, then I am at a loss to understand why he waited until after she'd had the children less than 24 hours to fill her in on such an important detail.

Crystal, given two options: take Jr herself to this dr appt she'd just learned about, meaning she'd have to get the two children up, dressed, fed, and out the door no later than 6 a.m. in order to ensure they're there on time...not to mention changing the plans of whoever it was that drove her (since Marie was there, I'm guessing it would have been her plans that changed, too) OR return Jr that night (mere hours after she'd gotten them back for the first viist in 4 months, and given the manner in which Ronald had taken them from her in August, no doubt leery at the liklihood of his return) chose to miss the appt in favor of court.

You can make your assertions and SeriouslySearching can throw out accusations about boyfriends until the cows come home. Crystal's ACTIONS demonstrate a woman stuck in a no-win situation. She made her choice, and the point now is moot.

Also, if you are filing a petition for an injunction for protection against
domestic violence
, you can ask for temporary custody of your
child in your petition. However, any custody order that you get would expire
when the injunction expires.

Wonder why Crystal didn't do the part I marked bold?
I mean... since she was afraid of Ron and all....

She did. She dropped the injunction for protection when (as she states) Ronald threatened to keep her from seeing the children. People love to make the claim that it was a false allegation. Much like they love to bring up the fact that Ronald had to call for police when she was at his house (in HIS words) "gettin' her stuff" and she tried to take the children after he'd not returned them like they had agreed. He blocked in her car and wouldn't let her leave with the kids, and people constantly refer to this as "Crystal tried to steal the children."

People are quite cruel when the look upon Crystal and refuse to see the hell she was dealing with constantly. I make no excuses for a young woman making choices that I myself would not wish to have to make. I also give no quarter for a young man who plays tug of war with his own children.

All we know is that they settled into somewhat of a routine visitation schedule and, as Crystal says, they "got along okay" through the next few years.

The allegations of abuse to the children were what Crystal had been told. She would have been lambasted if she'd done nothing. She did the right thing to get the charges investigated, and in my mind, did Ronald a favor by having it done, so THAT could be put to rest, also. She was TOLD there was abuse; her attorney told her they had to have it investigated. It was, it was resolved. Case closed for that.

So if Crystal was in jail with a first degree felony, a violent one, hanging over head it wouldn't be a reflection of character, judgement, or parental ability? As long as her kid didn't witness the event it shouldn't be used against her in a custody hearing?

IMO, based on the way the Haleigh Forum has been SPLIT the last 6 months, if this was Crystal we would be hearing DCF needs to take away Crystal's parental rights etc., etc.

RJ is in Baker County until the weekend so he would not of been at the home when this happened.

How do you know this information? Do you have the schedule for when RJ is with his mother?

Jr has the six week visitation with Crystal, plus Ronald got every other weekend during that visit with Jr. It was posted awhile back with regard to having come to an agreement after the dispute over the Father's Day weekend visitation with Crystal when Ronald refused to give Jr over and there was a charge of interference with custody filed against Ronald.

what is in front of it. A court doesn't "rip" anything away without being properly asked to do it. A civil court can't "file charges" against anyone. That's why I indicated CS didn't know what she was doing. Without her bringing it to the attention of the court in a form the court accepts, a motion, it would not be addressed. Simple civil procedure.

The question of his "legal standing" was not raised and thus not addressed. I never accused CS of being brilliant. She could and should have done those things but didn't. RC & TN were quite skilled in manipulating the legal system-CS, not skilled at all. Unfortunately, the legal system is set up to be manipulated and that is why you need someone who knows what they are doing. RC & TN were always 10 steps ahead of CS who, IMO, is a rather simple and transparent person who was basically unarmed in the battle with RC.

Ah, OK! Now it is starting to make some sense...a new squeeze is what she was doing and the reason behind her letting the children go with Ronald to Texas!! (Yes, I really believe he did go to Texas with the children to work until someone can prove otherwise.)

Boytwnmom, why didn't the court rip those children away from him, file charges on him for "stealing" them, and give them back to Crystal when they realized he had no right to them?! Why didn't Crystal call LE and have him arrested if what he did was illegal?! Hmmm...evidently the court must have determined he had a legal standing or they would have done that very thing.

boytwnmom, an excellent post, some think just because things could or should be done, they are, but that is not the way courts work. I agree with you. Teresa knew how these things are done and she counseled Ron, Crystal had no one and no knowledge.

Boytown....Excellent POST!

I have to be careful because I could say a mouthful about MO. RC does know how to blame others, he is a master. Must be in his genes.

Regarding court..Yep, The one who is best prepared wins, not necessarily the one who is right.

She was sucker-punched! Let's hope if this newest arrest gets a conviction (pray) than hopefully she can have Butterbean.

The facts don't support that at all imo.

IMO, this is the perfect time for CS to prove her point about JR's safety.

Flossie, those are the facts, courts don't do the right thing because they see a situation and correct it unless a motion is made. Like everything else in this life, its all about making money, in this case for some lawyer. I have been in courts for years and this IS the way its is done.

Actually Porcine, the second paragraph which I should have bolded as I was responding to it, my bad, is strictly opinion, with no facts to back it up.

I was not sure where to ask this, but I thought Jr. went on his 6 week summer break around June 10th - 15th? That would mean Jr. is back with Ron? Anyone know?

The visit was delayed until after the 21st of June which was Father's Day, so I believe that he still has another week under their agreement regarding that delay. I sure hope so, because they need to get busy on obtaining an emergency order of protection so that he doesn't have to return to such an unstable situation.

What is the situation when a child's custodial parent is charged with a felony ? If Ron had not been bailed out, I wonder what would've happened ?

  • #399
If RC is not available, I guess she has to petition the court and it will cost her money and see if she can get them instead of TN or AS, if had them for backup (betcha). They will go and fight her for visitation, for sure. I am thinking nothing can be done about his rights since he isn't convicted of anything....I hope I am wrong...please let me be wrong!

Can you imagine the injustice of this whole thing? Our courts and judges are so liberal in their thinking, it is disgusting. Going to get much worse too, I'm afraid.

Like I mentioned before....they gave the children to OJ..doesn't that tell us something?
