This is dangerous strategy by Defence imo as Judge will remember this and it’s not like Schoenhorn hasn’t done this bush league tactic before. It’s all quite disappointing to see Defence playing these cards and his behaviour.

Judge: it's the Defense's role to prove the warrant was illegally obtained.

Judge says that the Defense is saying that the burden shifts to the State to show how it developed its source.

Judge can't countenance that!

Judge explains that the spoilt fruits can't be used to obtain a new warrant. It requires new source with new PC.

Balance: preventing LE misconduct vs the jury hearing all the relevant probative evidence.

Judge cites rules of exception.

It's a saving stroke.

Court is persuaded by the State.
