JS: is not our intention to put in the 88 page report

Intends to put in the summary page. Dr. Herman.

  • #122
Defence Counsel is making no mention of the fact that Judge Heller tossed the discredited report from the Family Court file.

He now claims that MT knew nothing about the hearing in Family Court. I'm calling total BS on this fact.

MOO

JS is saying it's all irrelevant to his client because she wasn't even there. At the hearing.

  • #124
If she knew nothing about it, then why did MT bring up the report during her interview with police?

  • #125
Ooh, MT told the GAL she was going to leave FD due to the custody battle

  • #126
MT apparently was going to LEAVE FD due to the issues surrounding custody and divorce case per FD!
MOO

  • #127
Amen to Atty Manning putting pin to the issue of Judge Heller kicking the report! She is pointing out each of the LIES from Defence Counsel as to his characterisation of the report.

Judge sees relevancy, Judge accepts the State's scope.

Judge cites what's already been testified to on the record.

What's relevant is not whether the defendant could or couldn't be present for visitation, but what is relevant is frame of mind.

Meehan can testify that FD was worried the defendant would leave him.

  • #129
Now Defence Counsel is simply telling a whole series of WHOPPERS!
MOO

  • #130
JS just swore.

  • #131
MT on PHONE on her lap I think.

  • #132
Judge R is steaming!
MOO

  • #133
Judge reiterates --

Anything related to the dissolution: not relevant, not allowed.

When did supervised visitation go into place and what was FD's reaction to that? That narrow.

  • #134
With the above restrictions, Judge allows the testimony.

  • #135
Now onto the cellphone suppression

  • #136
Warrantless seizure of MT cell phone was denied by Judge R previously in prior suppression order.

  • #137
JS just swore.
Methinks his tack (ridic assertions about FD) and increasingly unhinged presentation has Mama Troc (and his unhinged client's) fingerprints all over it. I think he's under tremendous pressure. Too bad. MOO

  • #139
Warrantless seizure, subsequent warrant

Judge is not going relitigate. Only summarize --

State is not going to elicit content from the defendant's phone.

State has warranted records from AT&T. CDR records.

  • #140
JS just swore.
Wth did the judge at least smack him for that. JS gets away with to much. Ugh I wish I could watch today jmoo
