I’m still ruminating on the KM situation. I don’t think he could testify without perjuring himself which would void the immunity deal - even if he did so unwittingly.

We just know he spoke for 3 hrs with LE which I believe was his second interview. That transcript was never released and we don’t know what was said. The meeting was leaked by defence in their motion at the time but we have no clue what happened. Det Kimball confirmed today that the KM charges are still pending.

No - just saying if there were one, I’m not sure he could testify without perjuring himself. There is just so much to go after on cross I think he might just be unwilling to testify.

Judge has a motion to quash to take up in the morning before the jury comes in at 9:30.

JS doesn't think there's any need for a hearing. JS says he won't get into custody or privileged areas.

JS wants to use the witness to confirm when things happen.

Yes, that’s what I figured about state trying to avoid a circus or another call for mistrial.
Just too risky with limited possible upside for state was my other guess but I’m not sure.

Judge says they will take a break after the Defense rests for both sides to prepare for a contempt hearing.

Did not want to interrupt the trial with the contempt issue.

The Judge will not impose sanctions or sentencing at that time.
