I could be wrong, but I thought it was a Fourth Am violations? Seizure without a warrant? Boy Oh Boy, do I agree. Let’s see the phone records! Defendants who are “innocent” would gladly hand over their phone records. Might help their case, but we all know MT’s phone records will NOT help prove her innocence. Nope.
Thank you for traipsing through my typos.
I'd really like to revisit that ruling.
It was the elephant in the room at trial.
Stay would it have shown? She claimed she was on the phone during the trash odyssey, I think other evidence supported that, but where was it all afternoon?
Convenient that MT claimed to have showered with FD when it served his alibi but that she slept with her daughter, on account of the unthundery thunderstorm, when it served hers. An answer for everything.
Funny how the alibi scripts contained all the 'nothing to see here' activities of the day but none of the relevant ones.
IMO it wasn't even what might have been
in MT's phone records that area most compelling but what
weren't there. Like a thousand, expletive-laden texts asking where he'd been all night, why he wasn't home, whose bed his boots were under.
I'm thinking she wasn't very bothered by his unexplained absence, now proof she knew where he was.
But we knew that.
