Attorney for Jennifer Dulos’ mother accused of acting like a ‘prosecutor’

The attorney representing Jennifer Dulos’ mother in civil lawsuits has questioned Michelle Troconis “as a prosecutor would,” according to a new court filing.

Attorney Andrew Bowman, representing Troconis in the charges filed against her in the disappearance of Jennifer Dulos, is again seeking to avoid having his client provide answers during a deposition on her former boyfriend’s finances.
Attorney Richard Weinstein, representing Jennifer Dulos’ mother, Gloria Farber, has been vigorously battling Bowman over Troconis’ deposition in the civil proceedings.

Bowman tried to quash a subpoena requiring his client to testify, but a judge overruled the motion, saying Troconis could invoke her Fifth Amendment right to avoid
answering particular questions. Troconis appeared at a deposition in late September, but refused to answer any of Weinstein’s questions, invoking her Fifth Amendment right each time.
Weinstein is continuing to press for Troconis to answer questions regarding the finances of Fotis Dulos and his company. But Bowman contended in court papers filed Tuesday that Weinstein is questioning Troconis “as a prosecutor would” even though he had agreed to not ask any questions about the disappearance.

An examination of the questioning indisputably demonstrates that (Farber’s) counsel is asking questions that are the mirror image of what a prosecutor would ask,” Bowman wrote in a memorandum filed in opposition to Weinstein’s motion to compel Troconis to answer his questions.

Bowman contends that federal and state case law indicates that Troconis has an undisputed right to invoke the Fifth Amendment when answering questions that could implicate her in criminal proceedings.

The questions asked during the deposition have been sealed from public view. Bowman also argued in the memorandum that his client’s comments to police were not an indication that she is required to answer questions in a separate civil proceeding. Bowman also pointed that Troconis is a third party to the lawsuit and is not being sued by Farber.

Weinstein claims in previously filed papers that Troconis “abused the invocation of the Fifth Amendment privilege” by refusing to answer any of his questions.

Hartford Superior Court Judge Cesar Noble has not ruled on any of the motions regarding Troconis’ deposition in the lawsuits.

Weinstein hopes Troconis could shed light on Fotis Dulos’ business dealings, which he contends would show that he was shuffling money from his high-end real estate business to his personal accounts, including travel and meals they took together, according to court papers.

Weinstein said he wants to establish any benefits Troconis may have received from the Fore Group, including access to a motor vehicle and travel to determine "whether or not Fotis Dulos maintained true separate corporate identity for the Fore Group and the sanctity of that corporation as opposed to using it as his personal piggy bank."

Attorney William Murray, representing Fotis Dulos, is calling the $2.5 million a gift from the family since there are no promissory notes.

BBM: you know, Norm Pattis keeps using that “if this were Christmas” analogy. This is going to be far worse than a lump of coal...

“Like kids at Christmas, everybody's got to wait until we unwrap the package."
Pattis Debunks 'Gone Girl' Theory In Missing New Canaan Mom Case
“It was like waking up Christmas morning and getting an IOU,”
Jennifer Dulos case: No ‘clear video’ of Fotis dumping bags, Pattis says

So weird.
I've thought myself it's going to be like Christmas morning when FD gets charged and thrown in jail.

I'm not sure if MT's business was ever intended to supply rugs that you can buy in handfuls of other places (at a lower cost) or if it was just a pipe dream all along, though I agree that MT's insta has EVERYTHING to do with communicating outside of the bounds. There was a posting 'pause' from around a month before Jennifer's disappearance until July 1st, when a post appeared again. I find that to be curious as well.

The posts feature more about horses, scenery, coffee, tea, and flowers than cowhide rugs. I obviously don't know if FD and MT have an escape plan to run off to Argentina, and the messages/posts that I've seen since going private are even less obvious than when she was public...and perhaps she is just being more careful? Is it because she knows LE is onto her? Does she now have to keep up the ruse of having a business?

When she does feature a rug, there is no style number, cost, size, full picture, or direction on how to order...all important factors when one wishes to purchase an item listed on your 'business' account, IMO. I will say her hashtags are down in count, and she appears to be enjoying wine, tea, and coffee quite a bit lately. MOO
Is her "rug business" just a side gig to look legit and throw everyone off the fact she's in it with FD shuffling money overseas?

I used to kind of give MT the benefit of the doubt, thinking the fog would clear and she would turn on him. But bc she hasn't yet, this tells me everything I need to know. She's as guilty he is, in my opinion. She's a fool.

IMO this response is more than a bit 'stunning'...Atty Bowman is now criticising Atty Weinman for simply doing his job and seeking information. Perhaps we should add this new tactic to the CT Judiciary List of what to do when you are in trouble (FEEL FREE TO ADD AT WILL)!:

1. DELAY DELAY DELAY - NOBODY CARES ABOUT TRIAL, JUST KICK THE CASE DOWN THE LINE, JUSTICE ONLY MATTERS FOR OTHER PEOPLE

2. ACCUSE SOMEONE OF BEING A PROSECUTOR WHEN THEY ARE MERELY DOING THEIR JOB AND SEEKING INFORMATION IN DISCOVERY

3. SCHOOL THE COURT AND THE PUBLIC ON YOUR INTERPRETATION OF THE US CONSTITUTION - YAWN, NOBODY CARES ABOUT YOUR INTERPRETATION OF THE CONSTITUTION Atty. P.

4. DON'T TELL THE TRUTH AS WE ALL KNOW NOBODY CHECKS THE VERACITY OF STATEMENTS MADE IN MOTIONS (NEW WORLD ORDER) - TRUTH TELLING IS PASSE

MOO

Not sure - she just accepted my request and followed me back. Perhaps because I'm in architecture and development?

Welcome, Cape Winelands Guy! I haven't seen you post previously.

Wow it's so cool to have someone from South Africa on here! It makes me wonder: is this case news all the way over there? Wow! That's amazing.

I'm a little confused, though, as I thought her products were geared toward the home owner and decorator. Do developers decorate houses with rugs these days?

How much is the shipping to SA, I wonder? She must really want to sell some rugs!

Trying to throw everyone off,
Trying to pretend FD and MT are estranged but, in actuality they communicate,
Trying to show MT was a victim and FD tricked her into taking EE’s keys, Dump run,
Car wash.
Trying to create a shroud of innocence to influence the Judge when he reads the Motion.

Zero to no demand I'm guessing. Zero sales on her EBay acct since Feb 2019. Hahaha

I believe that is nowhere in any of the filings . That is something written by the reporter Lisa Backus.

I wondered why a guy from South Africa was posting here. I thought maybe an ex-expatriate. Seems to be more.

“As a prosecutor would”? Does he mean “As someone who is fact-seeking would”?
