Wow, so it was JD's blood DNA on the "bank box" tools and MT's lawyer(s), former and present, had possession of the "bank box" with items (including a letter from MT's present attorney), for years combined, before turning them over to LE. All that and the judge decides that attorney can continue defending the accused?

MT's attorney handled and kept the probable murder weapons a secret and because of unknown and intentionally veiled chain of custody on those tools, MT's attorney is not held accountable professionally in any way for his actions! What's up with this CT judge, no backbone? And I live here, SMH.

My Lord, such a violation of ethics if not the actual law. What's MT's lawyer have to say? What was FD setting up his girlfriend to take the jealous-girlfriend-did-it fall but was too stupid to put his wife's blood on the "bank box" tools?

STAMFORD — A Superior Court judge decided Friday that attorney Jon Schoenhorn can continue representing Michelle Troconis, who is charged with conspiracy to commit murder in the death and disappearance of Jennifer Dulos.

The decision came after Judge Gary J. White questioned Troconis on what the state believed to be a potential conflict of interest. During the questioning, Troconis, who attended the hearing virtually and spoke through an interpreter, said she was satisfied with Schoenhorn's representation and waived any potential conflicts.

Stamford Supervisory State's Attorney Michelle Manning filed a motion in October seeking Schoenhorn's disqualification from representing Troconis on claims he could be a potential witness after he refused to say where he obtained a sweatshirt that could be connected with the case.

Assistant State's Attorney Sean McGuinness entered an exhibit into court Friday that stipulates neither the state nor Troconis' defense will present the box, which contained the sweatshirt, and proceed as if the contents of the box did not exist.

What's her objection? That officers watched her take her hair dryer and helped secure it in her car?

One can only wonder what she wanted to take (to hide it) but couldn't...

It was right and proper to lock down the house. If anything, it was a courtesy that she was given access at all, allowed to remove anything.

A courtesy she didn't deserve.

What’s she afraid that they found? You know, since she’s innocent, and literally had no knowledge of fD’s actions that day. Oh, and “HER residence”? She never paid a nickle to live in that house. The only person to whom that residence belonged, was Jennifer Farber Dulos, who still had possessions there, because fD wouldn’t permit her to take all of her stuff.

Most of the time, they don’t let you back in, to get anything. Hey, remember when Jennifer wanted to get back into HER HOUSE, with movers, to get her stuff? Didn’t fD refuse to let her in there to get everything that belonged to her? I am sure that by then, MT was already the “lady (ugh) of the house”.

I think this latest motion is designed to push Michi’s trial date off into some date in the future, among other things, and it doesn’t surprise me. Do they really think that the State of CT will eventually drop the charges against her if they keep stalling?

Has the State filed a response yet? I doubt this will go anywhere -- this was a matter of law and the Court ruled there was probable cause. How tiring of JLS.... and his billable hours. JMO
I forget how the saying goes, but it’s something like “…if you don’t have the evidence on your side, pound the table…”. I guess JS is pounding the table. It does seem to be a ridiculous argument to make, especially since this one’s already been turned away. But maybe the Troconis family is insisting on it, and is willing to pay the bill for it. Otherwise, he just looks like a jackass, making this same motion again.

In a series of motions, Schoenhorn was seeking to have a number of items gathered at the Jefferson Crossing home thrown out as evidence, including documents and electronic devices belonging to Troconis, her mother and daughter that were seized during the search.

Schoenhorn and state prosecutors sparred for hours over several days in recent weeks on whether the evidence was seized properly or without a warrant.

But in an 18-page ruling issued Tuesday, Judge Kevin A. Randolph denied most of Schoenhorn's motions, only agreeing that an attorney bill to Fotis Dulos from the lawyer representing him in his divorce will be stricken from the record because police "had no probable cause to seize the document as it was outside of the scope of the (search) warrant."

Randolph ruled that a list state police called "alibi scripts," detailing the places Fotis Dulos and Troconis went on the day of the disappearance will remain on the record. In his decision, Randolph determined the handwritten timeline was relevant evidence since it contained the name "Jennifer" at the top and was dated the day she disappeared.

"The seizure did not exceed the scope of the warrant and was not unreasonable," Randolph said.

He also allowed the 20 pieces of electronics to remain as evidence, the ruling said.

The judge previously denied Schoenhorn's motion to change the location of the trial from Stamford to Hartford. Schoenhorn argued the publicity the case received in lower Fairfield County impact the jury pool. Schoenhorn estimated that jury selection could take more than a month and has also said that he would resubmit the motion to change the venue of the trial if he felt it was difficult to find unbiased jurors.

In a separate motion that was argued before a judge last month, Schoenhorn also argued that evidence seized from the Jefferson Crossing home should be tossed out on the grounds that it was obtained via an “overly broad” search warrant.

On Wednesday, however, Stamford Superior Court Judge Kevin A. Randolph ruled that the police affidavit provided probable cause for the search.

"The warrant did not fail the particularity requirement of the Fourth Amendment," Randolph wrote in his decision.

In his objection to the request to suppress the evidence, Assistant State’s Attorney Sean McGuinness argued that evidence found at the New Canaan scene and in the Hartford area, led investigators to believe that there could be evidence at the Farmington house.

"This court should not read into the search warrant in hypercritical ways," McGuinness said, adding that he did not believe that Schoenhorn had made enough of an argument to question the "facial validity" of the warrant.

Randolph, who will hear arguments next week on a change in venue in the case, said he does not expect to render decisions until early September.

In state Superior Court in Stamford, Assistant State’s Attorney Sean McGuinness and Troconis' attorney Jon Schoenhorn argued about the defense's motion to suppress evidence seized at 4 Jefferson Crossing. Troconis was living at the Farmington home with Fotis Dulos when his estranged wife disappeared in May 2019.

Superior Court Judge Kevin A. Randolph said he plans to file his written decision on the matter by next Tuesday [10/3/23]. Earlier this month, he ruled that the police affidavit provided probable cause for the search.
