Yes, and I suspect if certain vehicles are left in reverse (I.e. not placed in park) one might not be able to remove the key? (Perhaps that is another reason the battery was drained, maybe it was left on or not entirely shut off?) MOO
So sad, if this is the case, that no one noticed/reported the running unoccupied vehicle before the battery died.

Usually for local crime they do a solid job reporting imo.

If the car was running, it would have run out of gas, not have the battery die.

Do we know if letting the battery run down completely impacts the vehicle computer system and ability of law enforcement to obtain useable data? We haven't heard any testimony yet about the GPS/On board system for the Suburban but I'm curious if perhaps that might have been a reason why the vehicle was left running? We've run into this issue on other cases but I don't recall the technical impact on the system of running down the battery. Does anyone know? My sense is that FD researched many things and I don't believe leaving the vehicle running wasn't a random act on his part.

Testimony from LE yesterday I believe was that the battery in the Suburban was dead. My recollection was that the testimony yesterday also mentioned that one/or more of the doors was left open and imo this could have run down the battery. Will have to go back to original arrest affidavit to confirm but I believe the Suburban was inoperable at the scene and even having the key fob from Welles Lane would not start the vehicle when it was on Lapham Rd. The Suburban had to be put on a flatbed to be secured at NCPD Headquarters and I believe this was mentioned yesterday as well in testimony from LE.

I'm not sure... I remember back in the day the general consensus was that SOMETHING went wrong in that garage. He was so unprepared for the clean up. My initial thought is he was still running on adrenaline and not thinking straight when he dumped her car at Waveny.

Exactly. Are we sure the car was left running? That doesn't seem to jibe with a dead battery.

I do recall that they were left on. From Section 4, page 2 of Troconis Arrest Affidavit signed 1/6/2020:

Maybe the car being left in reverse kept the "OnStar" module active until the battery ran out? I see there was a Service Bulletin for 2017 Chevy Suburbans (among other models).
Yes. I'm not a technical expert but I don't think its a mystery that the vehicle was left the way it was by FD on Lapham. Will have to go back and see the arrest affidavit. Gray Hughes did a rehash of the arrest affidavit the other night and I believe he might have discussed the issue of how exactly the car was left on Lapham. Will have to go back and double check the details.

Generally true, but apparently (you can find many complaints online) there was a problem with multiple 2017 Chevrolet and Cadillac models (as identified in that Service Bulletin) experiencing dead batteries as a result of the OnStar module running continuously and drawing down the charge. I would guess that was particularly a problem when vehicles were only used for short trips.

Thanks! This I guess would mean gas would run out eventually but IDK the impact of leaving vehicle in gear? Would this have same impact as leaving doors/lights on and open and would effectively run down the battery and potentially impact the OnStar? We might have to wait for a subject matter expert from Law Enforcement or OnStar representative as we have seen in other cases where the computer data is critical.

Whoa did JS misrepresent Moody.

Presumptive tests alone is not probative. But there are other factors and additional testing that supports admissibility of presumptive testing. In particular in this case when in conjunction with a missing person.

Complex explanation by the judge. He is so measured, so thorough. Really like him.

He's allowing it.
