Defendant is asked if FD was home when she returned with her groceries. She says the Suburban was there.

She describes something about FD and mileage to explain who drives which cars.

Describes using her computer. Invoice.

Officer asks her if she saw FD. She describes that she didn't look for him. Long explanation about how cars are usually parked in the garage.

Backtracks to describe bringing the garbage cans out. Empties trash, washes dishes. Finishes eating. Describes levels of the house. Uses her computer.

The receipts are crazy to me too... How much does she have in her purse that she has receipts for groceries from over a week ago? Does she shove every single thing she's handed in her purse?
I'm surprised it wasn't kept with the alibi script in a folder labeled "ALIBI."

Lunchtime has shifted from noon, as originally stated, to 1:00, then 2:00.

They try to clarify WHICH time. "Between that time."

(Surveillance captured MT driving Jeep followed by FD driving his Suburban arriving at 80 MS Rd at 1:36 pm.)

Whatever he said in that report, Dr Herman couldn’t or wouldn’t back up with evidence, when he was grilled in a court proceeding in front of Judge Heller, by Reuben Midler. He refused to testify further once he began to get pushback, which is why the report was stricken from the record, and the hearing was halted. The report was not only stricken from the record, it was sealed, and no one was supposed to receive it, copy it, share it, or use it in court. And yet, we’ve all seen what has happened with it, along with continued references made to it, both in police interviews, and in this trial in the first week.
Thank you for posting this info for the record on this thread as it relates to something that happened long ago in Family Court.

I don't believe Judge R. is correct on allowing testimony relating to this report to continue.

IDK why State isn't objecting either?

Alibi script as recited by MT in the interview (NOT=) what LE already knows.

Defendant describes how FD called to her from downstairs to have lunch. She was in the daughter's room. Between 1 and 2. Rinse and put in the dishwasher. Sometimes she doesn't rinse. Uses a paper towel.

Then FD calls her. He calls on the phone because the house is big. Need to go to Mountain Springs. I have to bring all the cleaning materials. Vacuum, thing to sweep, paper towels, garbage bags. Says she traveled alone in Cherokee.

Backtracks to describe a 15 minute conversation with a lady about rugs.

Says she drove the Cherokee to 80 MS. FD drove the Suburban. Officer asked if FD left when she did. "Probably."

She describes unloading the cleaning things in the kitchen, then goes to the second floor bathroom.

Officer tells her FD's phone was at 80 MS during the time she said he was still at 4J

Officer asks her what she did that day when she arrived.

Usually....

Officer stops her, no, that day.

Officer shows her a map, asks her to show where the Suburban was....

Challenges for MT to reconcile the alibi script when confronted by LE and reality as captured on video. Hope the jury is watching this closely.

Watching the 'not alibi script' testimony from MT is painful and the detail absolutely stunning but largely irrelevant. Detectives body language is quite amusing too. Lots of imo deceptive behaviour coming from MT too in this testimony. Detectives must have had a field day with this replay.

Sounds like she's been coached to be as vague as she can be in the interview with LE. "Probably" and "usually" qualifiers so she can't later be accused of lying to law enforcement.

MT thought it was weird that Fotis recently purchased a pair of black jeans.

  • #691
Did she just say that she was trying to stay aware of the time because she usually has to pick up N from school at 3, but then remembered that that day, she did not have to pickup as N was going somewhere else that afternoon?

I remember that someone here speculated long ago that N wasn't at 4JC that afternoon - was that @afitzy or @Tink56?...

They find the scripts the day after this interview, yes?

Defendant describes the Suburban in front of the garage. FD was in the garage, walking. Garage door, open. Wearing jeans, light blue shirts. Says recently FD bought black jeans.

Defendant tells FD she has to be able to pick daughter up from school.

Defendant takes the Suburban to 4J to drop off a vacuum and pick up a broom and returns to 80 MS. 7 minute drive.

She's struggling so hard with all of the little details they clearly didn't bother to go over when they came up with their "timelines."

Defendant thinks FD was outside, on his phone, even she arrived the second time.

Defendant talks about being back at 80 MS, 4-4:30-4:15.

Talks about daughter and a program she has at 7pm.

Wore exercise clothes in the morning, that's her routine. Wearing her camouflage pants, a shirt.

Around 5:17 she talks to the lady who says the store might close at 5:30.

Now she's talking about FD and PG talking. PG she's his wants motorcycle.

[This is impossible to transcribe in real time!]

She says that at 6:30 or 7, Fotis says let's go to Starbucks.

Soooo much detail.

Replying to my own post because there is something written in red on the back cover of that paperback book. I've played around with sharpness, brightness, contrast, and color saturation to see if I can make it out.

Curious if others see the same letters that I think I see.

It’s so gory to see all that blood because we know she was there and she knew. How did she hold it all in? It’s over for her. These pictures are astounding.

JS is threatening the court by saying he'll play the entire video again and stop it in order to clarify the contents. The audacity required to approach the court in this manner is very bold.
I would suggest it’s ill advised and stupid as well as inappropriate.

Judge R was not amused imo.

Fotis drove them in the Raptor to West Hartford. Officers ask where they went. To Starbucks, that was the plan.

Usually she went to a closer Starbucks.

She describes at least one garbage bag into a dumpster. FD was driving around. She describes turning around. Didn't make sense to her. Twenty minutes.

Officer addresses her attorney, tells him there were 30 stops....

State pauses. Asks the witness if 30 stops was accurate. No. Was it a ruse? No, it was information witness had that was later determined to be incorrect.
