JS doesn't have his evidence helper, struggling with his AV.

I do very much wonder about the idea of a secondary location prior to their return to 80MS. I also wonder if they might have gone to a hotel or other location with a shower to clean up too? This is speculation but I'm not sure the ponchos would have been enough protection from whatever was tragically done to VICTIM, JF by FD and MT imo.

My hope is that the computer data from the vehicles might tell the story.

We know that the Tacoma/Red Truck is too old for such data but the other vehicles might have provided some of the missing data to LE that was never disclosed in the AAs for FD and the Co Conspirators.

Hope the day that this data is revealed will be soon but the State is far from laying foundation for that line yet I am guessing!
MOO
Interesting. What could the vehicles data show?

The witness already sounds annoyed with JS ... good morning all ... patience... something really good and worth waiting for must be coming soon! Moo

Depending on the system that the vehicle has in place the data can be everything from doors opening, starts, stops and gps data etc. Some systems are incredibly sophisticated so fingers crossed some might be available here.

The jury's dreaded words spoken by JS ?
" OK, so Let me just break that down a little.."

I almost wish they were allowed some Bailey's in their coffee.

I am so annoyed at defense counsel’s questioning method. He seems to pose the question in the form of the answer he wants then says “correct” or “right” in an effort to force the witness to agree to the answer he has formulated. So tiresome.

JS begins cross, picking up with the tied trash bag

Witness corrected to knotted bag

He asks if she unknotted it. Asks her if she was aware if anyone untied it and retired. Asks her if she was aware that it came from a trash bin with other trash bags and loose trash.

Asks her why she wears protective gear. She describes what they were, how they clean their areas.

[I see where he's going. Witness doesn't.]

He's moved on to her form again.

Witness is explaining herself very clearly. How the exhibit was processed, items separated (by the fingerprint analyst) and distributed to different analysts.

JS is now asking if there was more than one green and yellow sponge. Witness has no notes about another.

JS: so did you see the sponge?

Witness: the contents were already removed when I analyzed the bag.

JS: did you examine this green and yellow sponge?

Witness did not.

[That was ridiculously convoluted. We were tracking. I don't know where JS was.]

Why is this not badgering the witness?

Where is the State?????

  • #332
Looks like we are heading down the long path where at the end of it we see MT dna on sponge and on the cleaning crew.

  • #333
I like Ms. Roy. She can really hold her own. I do wish the state had her back a bit more though.

  • #334
Why is witness being asked about items she didn’t test personally?

  • #335
Upholstery cutting

JS asks witness to describe her process for analyzing the cutting.

Asks her if she knows what side the cutting came from. Directs her to an email to refresh her memory.

JS: so LE was unable to say whether the fabric came from the passenger or driver seat...

Witness testifies that, to the naked eye, she didn't see any staining on the fabric or foam backing.

End of cross.

So agree. State is imo not protecting its witness.

State on redirect

Witness is explaining why she didn't test certain items. Because there is individualized testing. DNA analysis is a better confirmatory test.

Objection, leading

Judge, this is developed yesterday, this isn't leading or testifying, overruled.

Witness explains how analysts don't want to consume samples or diminish samples or interfere with our testing.

State asks why they clean with bleach. It destroys biological material.

So if something is cleaned, bleached, goes through a car wash, could that destroy biological material? It could, it depends on the reagent.

  • #338
Re-cross

JS asks if she knows of car washes that use bleach.

She isn't familiar with what car washes use.

  • #339
JS is really really really stuck on presumptive blood testing - so glad Ms Roy set him straight!

  • #340
State asks if vacuuming a car would get rid of evidence. Objection. Outside scope. Judge now we're talking about car washes. "Car wash is not the key that opens every door. Overruled

Withdrawn
Witness steps down.
