It's my opinion that JK is the ring leader. (JMHO, MOO, OMO, etc.) But I do think that his trial will be completely different and his lawyer just might have a shot at getting him LWOP. Hang on folks, I think it's going to be a bumpy ride. Probably a lot worse than SH's trial, which I know seems impossible. I'm going to need a full box of kleenex within reach at all times.

I agree with all the points you have stated. I do believe he was the ring leader but believe his defense to be aggressive.

Komisarjevsky has made it known that he feels Dr Petit is a coward who did nothing to defend his family, and Komisarjevskys version of what happened in relation to Dr Petit varies widely from what Dr Petit says happened

they will challenge Dr Petits version of events, they won't put the kid gloves on when they cross examine him,

Why do you think JK would have been silenced by a plea agreement? He would have still been able to correspond with any reporter or author that he wished. He still retains his first amendment rights.

The real irony I think is that given the nature of his crime, he is more likely to die sooner in the general population that he will from lethal injection.

one of the reasons why defence wished to keep witness list secret, and why a Judge finally got it after many many hearings and sealed the defence witness list,

if this can happen to a witness who did not wish to be there and was subpoenaed to be there then what will happen to any witnesses who choses to testify to try to save Komisarjevskys life,

we shall see what happens when it comes to the defence calling witnesses and whether there identity becomes known then

many plea agreements such as Rader (BTK) have included in them an agreement that the defendant signs which means he/she is giving up there rights to ever speak to the media, and that keeps them silent, that could have been put in place as part of the agreement, it is obvious Komisarjevsky really wishes to plead Guilty for LWOP as he does not wish to live out his life on death row,

he would have likely been willing to sign an agreement banning him from speaking to the media,

3 weeks for trial, 8 weeks for penalty phase, and defence in opening immediately questioning what Dr Petit remembers by saying that the beating with the bat may have impaired his recall of events,

it is easy to police, every letter he sends out is read pre sending by the jail, every phone call is listened to, every visitor is vetted, he will live forever in a maximum security prison, any acces he has to the outside world is approved of and vetted by the prison, if there is a standing legal order he has no contact with the media the jail will ensure this happens,

we have heard not one peep out of BTK since his incarceration because the jail ensures he has no access to the media, there are other cases where there has also been an agreement that the defendant has no contact with the media but I can't recall those names now

and the state and Dr Petit would hope to never ever have to hear from Komisarjevsky again once this trial is done, Dr Petit does not wish to read more books or articles that Komisarjevsky will co operate with post trial, but as of now there is nothing to stop him taunting Dr Petit for as long as he chooses

Personally, I think it is the fear/anger speaking out from Komisarjevsky that makes him make such statements. Fear and anger that he messed up by unintentionally leaving someone alive to tell/witness his cruelty and sickness.

I disagree, I think correspondence is very easy to control, plus most media organisations would be wary of violating a court order that prohibited Komisarjevsky from talking to them, Raders jailers have kept him silent, I am sure that Komisarjevskys jailers could do so,

He could simply have the statement mailed by another inmate or given to a guard to slip out, or an attorney whose correspenence is protected from being read. And the court order applies to the defendant, not the media. An author or newspaper, or blogger wouldnt think twice about publishing that.

by insisting on going for the DP Dr Petit and the state are ensuring neither Hayes or Komisarjevsky is going away anytime soon, Hayes already has the DP and with that goes a lot of state money to aid him in his automatic right of appeal, all his attys need to find is a technical error that another judge feels affected the trial and he gets an appeal and back we go to another trial, it will be very hard to find reversible error but they have time and money to keep looking for one,

same goes for Komisarjevsky if he gets the DP,

by taking a plea the state could have included in the agreement that both gave up there rights of appeal, that they serve LWOP and that they have no access to the media and can never give interviews ever

I expect Komisarjevsky will once convicted give interviews to the media for a long time to come, he has only been kept quiet because of the gag order in place, once the trial is done and dusted he will be free to speak to whom he chooses and to have in placed in the public domain, he has shown he wishes to communicate with the media by his original letter writing to an author pre his attys and the gag order shutting him up,

he has shown he will continue to taunt and attack Dr Petits character and that will not stop

a plea would have ensured he was silenced forever,

Apparently Mr. Petit and I agree that one should not "bargain shop" justice. Yes, it's expensive to administer justice - but on principle it is much better to have them face the fact that they will be put to death for their actions. I have to respect what the Petit family wishes - they have their reasons, and I have mine. It's a justifiable killing to put these criminals to death. I pray the state of Conn. will work through the appeals process in a timely manner and finish the job. You are correct that a reversible error is unlikely - we have the appeals process in place for good reasons and I'm absolutely confident that in this case, no innocent men will be executed.
