“This court incorrectly imposed the shortest period of incarceration it could possibly impose,” Nel said, especially based on the finding that his actions had been grossly negligent.

He said the court had found that Pistorius was not a truthful witness and therefore the judge should have rejected the “plethora” of different defences the athlete had relied on during trial. If the court had taken the circumstantial evidence into account, it would have rendered Pistorius’ version of events on the night of Steenkamp’s death impossible.

“This court should either have accepted or rejected Pistorius’ testimony as a whole,” Nel argued, adding that if Masipa had done so, the end result of the trial would have been different.

I'm having a tough time, full stop. I think I was on another planet yesterday. I changed my first post on page one but left in two words that should have been deleted. Then I said du Toit whispered to Masipa ... there were no assessors present (I wasn't watching as I was trying to find a good twitterer to follow). And finally I said Grant was clean-shaven in court. He wasn't. Nope, I wasn't on medication. I think I'm just plain exhausted from it all.

Today's a new day, I'm feeling refreshed and looking forward to hearing the sound of us all cheering from around the world ....... I'm a glass half full sort of person

When we come back for the appeal, I hope the mods put on a super platter of goodies for us.

So Roux can't use June's comments after sentencing. And rightly so. They're immaterial and can't influence leave to appeal.
