Does this Motion Make Sense?

In reading this morning article I see Sheaffer says that Casey does not have any legal rights in jail. It also states the video was from when Casey learned Caylee's remains were found. Which the only way she would know if they were Caylee's is if she was the one who murdered her, because they never said it was Caylee...they said possibly, not until later did they say it was Caylee. There is still little Trenton missing and other children and it could of been one of them.


The video reportedly shows Anthony doubling over and hyperventilating after learning her daughter's remains were found as she watched Channel 9.

Sheaffer says even if Baez tries to claim Anthony's right to privacy was violated, it is likely the judge will still release the video.

Hasn't Baez twice been serriously admonished for violating jail security and contact protocols? There is no way that the jail will ever consider not monitoring his contacts with an inmate. The policy is there principaly to insure among other things the safety of every lawyer that comes into the facility, his own stupid butt included.

Yep, inappropriate touching and smuggling in a contraband bracelet to KC.
There is so much stuff going on in this case I had forgotten about this too.
 
I'm going to comment about the structuring of the motion by Baez. HOLY CRAP! Did this man pass the bar exam? Seriously. I have worked for attorneys for 25+ years, and now work for a Judge. I see some crappy work product from some attorneys, but nothing, NOTHING like this.
 
Wouldn't you hope a criminal sitting in a jail cell would be monitored 24/7? Regardless if an attorney is there or not. Who's to say she won't hypervenilliate again over news of something negative like say a possible release of a jailhouse video. All this noise comming from JB's camp has me thinking someone should monitor KC for a suicide watch the day the video is released. Those two together is a scary thing to be left alone could be dangerous or coniving from what has been said to date.

The right to privately discuss your defense with your attorney is a VERY basic right. If jail officials are monitoring Casey's discussions with her attorney, and it sounds as though they may have, then this plays right into Casey's hands. If jail officials break this law, the defense can ask that nothing they've overheard be used against Casey, and ALSO can raise the issue that if the jail officials will break THIS law, what ELSE will they fudge on?

We all need to pray hard that this woman is treated fairly by all government officials and that she gets a fair trial. Anything short of that works FOR her.

I would think (and hope) so. I mean, just what if, what if, say..... you had an attorney who was madly in lust with his client and decided to slip her a hack saw or something. Wouldn't you hope that there would at least be video cameras to catch it???? Audio...no. But if JB and KC were put in a "classroom" as he puts forth in his motion for their meetings....what would keep them from doing the horizontal mambo for a couple of hours if there was not video???????
 
I concur! What if the inmate starts attacking their lawyer? Video monitoring is essential!!
Baez is just pulling a hissy fit, and noone is biting :)
 
I wonder why he waited until now to file this motion? The original hearing for the release of the video was on May 7th and was continued. He is making some pretty big accusations that the video was a set up. There are cameras all over the jail and all inmates are recorded for the safety of the staff as well as the inmates (Casey is not special), so I don't see how Baez can prove it was a set up and if he does "IMO" it would be because he paid someone off to say that. I could see him wanting to block a video of Casey in the infirmary, but if it was recorded outside of the infirmary, then how could that violate her rights? And even then, I feel anyone that is indited for murder should not have any rights until they establish their innocence and if guilty then all rights should be taken away. What rights do the victims have? But that is JMO.

Does this mean that today's hearing will be rescheduled as well due to him filing this late motion and the new attorney on board? Could the State come back after Baez for slander? This is some pretty big accusations for an attorney to be making if false. So many questions. I just can't wait for this case to go to trial and pray the justice will be served.:behindbar

This is high-profile DP case. To gain as much air time as possible, prosecutors and defense attorneys want to stretch things out. Pre-trial motions and delays create air-time opportunities for both sides.

Maintain focus on whether or not there is clear and unyielding evidence that proves premeditation beyond a reasonable doubt.

Dec 11th after KC saw Caylee's dumped body being found---JB walked her down a hallway and as they walked---they were being taped. He is bringing up the Client/Att. thang to cover his azz about this. He wants nothing released that has "ALREADY" happened. I don't know what they were doin. Also the video of them in the room where JB cried and KC was mad? Member all that? There isn't audio with the video, so he doesn't have a leg to lean on. I have been waiting for this to come back up and it has seemed to be shoved into a corner with this video of KC bending over bull s. I don't even wanna see that video----I wanna see the one they are hiding.

So you are saying there are two videos - one in the hall and one in the interview room? I agree with you - if there is something audio we have not heard, he does not want it heard. And if not, then there is something he does not want us to see. I would think any shock or dismay on her part (other than anger) could be used to his advantage. But perhaps he is worried that we will see yet another instance of inappropriate behavior on his part. So in other words, you feel he may be doing this to protect himself?
 
Is it possible that JB is still filing motions to stay in the courtroom and in the public eye? Therefore getting his free publicity? He's about to be brushed aside when the new DP gets started right?? JMO

Oh no, not brushed aside. I think he's gonna take on the role of PR Man Extraordinare, that he's already done this in fact, but he's gonna get even
cuter and louder and bolder. (Remember last year when his daughter worked for "his PR" firm? HE is the PR firm.) In this role, he can negotiate book deals
& movie deals, & reality t.v. show deals, and Big $$ Deal Bonanzas, and maybe even open a nationwide fast-food chain. Why not?
