Yes! I hope during his trial that they can get the medical examiner and TS family to testify that Mark was never privy to that information. It was a bombshell to me that Mark told CK the exact number of hits to Teresa. The only person who would know that is the killers and the Medical Examiner at that time.
Either the State just got the additional statements or they chose or even maybe forgot to give them to the defense.Ugh, after all this voluminous discovery, why oh why did they just not turn it over with the rest?
And I need more info as to how this would change JR's trial. Not seeing it.

I think it was disclosed before the trial. I sure hope Dr P didn't sit on that info these past few years.I mean, that's kind of some bombshell info. Can't believe Dr P just disclosed it now, you know?
DebG, we are the west coast late owls. The recent disclosures makes a lot of difference to the defense, but not necessarily for the ultimate decision a jury will make. I wouldn't want to be the person who has to tell Judge Kyle, "They're baaaack!"I think it was disclosed before the trial. I sure hope Dr P didn't sit on that info these past few years.
This is not good, folks. Not good at all.
I don't believe Petrites sat on this info for over 4 years and just now decided to tell the State. Makes zero sense to me. Why would he not tell them this in 4 years? He has no reason not to disclose it. He was interviewed several times by LE and deposed by the defense. I have spoken to several witnesses that were deposed and both Mummert & Fitzgeorge were at every one of those depositions. My hunch is that the State didn't turn it over until now because it is relevant to Mark's case but would have caused possible harm to JRs case. It is not a good look. At all. If my hunch is correct, it was a stupid strategy. This might have worked if Jimmy was the only one on trial but knowing they had Mark's case coming up and they were going to use the info then, they should have known this was going to happen.
I will be surprised if Judge Kyle doesn't grant Fitzgeorge's motion for a new trial. He is not going to be happy if he finds out the State had it & didn't turn it over. If he rules against the defense, they will appeal his ruling.
@AZlawyer Thoughts? Am I overthinking this? Make me feel better.
Without retrying the case here and just going off of the verdict & juror comments -
The jury obviously disregarded Wayne's testimony. The State never actually proved Jimmy was ever inside the house. It was pretty clear to me that the jury felt the conspirators were Mark & Wayne, hence his acquittal on the conspiracy charge. Per at least one juror, the primary evidence that convicted JR was the disposal of the jumpsuit and his phone.
If I was the defense and had this info, I would have argued that Wayne and Mark had yet another motive to murder Teresa. They were going to be charged with fraud. Jimmy was clueless when it came to the Medicare fraud, why would he want her dead? IDK if it would change the verdict but I don't think the jury found Wayne credible at all. I just think this would have been another reason for them to believe Wayne committed the act, as opposed to JR.
True. Seriously makes me feel better. I tend to overthink things. lolThere was already zero evidence that JRR would have WANTED her dead except for monetary reasons, though.
I know what you mean! I am so frustrated I cant imagine how TS family is felling. Prayers for their strength perseverance.DebG, we are the west coast late owls. True, I always believed JRR was in on the plot for the money thereby he was a co-conspirator and "hitman".There was already zero evidence that JRR would have WANTED her dead except for monetary reasons, though.
Okay, I have to ask this now. How did the bloody smear get on the door frame located in the back of the living room leading out to the pool/lanai area..? And when was the lanai door lock leading into the bathroom and guest room mingled with..?
I think it is very possible CWW and JR went to the outside pool to wash off after the murder.. The door in question may have been damaged previously in an unrelated event or - our guys actually locked themselves out on the lanai. That door has one of those knob locks. If you don't pay attention prior to exiting, it is super easy to lock yourself out. And we do not know for sure, when the garage side door was actually pried open as alternative entry.
I do not trust CWW in any way and can see, how he was/is still trying to protect JR IMO. When CWW was asked by the prosecutor, when and where they actually changed their clothes/coveralls, he stated they stepped out through the pried open garage side door, changed their clothes and placed everything into the backpack. Really? And where was the backpack during the murder? Outside, inside? How did they change clothes? Over a tarp? In the grass? They did not wash off anything, vomit, argue etc..? They just left, puff?
I really hope the pool was turned inside out - literally - as well as the area outside the pried open garage side door.
ALL IMO
