Day 3 in Drew Peterson's trial is about to begin. The defense will argue, again, for a mistrial with prejudice (which means Peterson couldn't be retried). If the judge strikes the witness's testimony-rather than grant a mistrial-the defense will ask for an instruction to the jury about the State's conduct.

Not good for those of us who don't have access to a tv. lol Anybody watching IS?

I, for one, am glad I don't have access to a tv today. Or that there is no televising of this trial. It is much better for my blood pressure.

I can't believe the Lifetime Channel,....

They're playing "An Officer and a Murderer" at 8pm and then "Drew Peterson;Untouchable" is on afterward.

I guess the Lifetime channel's made up their minds!

Only the second movie is about DP. The first is about Colonel Russell Williams. Lifetime seems to be replaying 'Untouchable' now that the trial has started.

Day 3 of the Drew Peterson murder trial is scheduled to begin at 10 a.m. ET. The defense is expected to argue again for a mistrial with prejudice. Judge Burmila suggested yesterday that the defense consider the possibility of striking witness Tom Pontarelli's testimony from the record as a remedy for the prosecution having elicited testimony that was ruled to be inadmissible.

Yes, katydid - I could see him doing "little" things, like slashing two tires, disconnecting the water or power to your house, throwing a rock through a nice French door, putting a dead animal under your house, just mean 14-yr-old kid tricks, just to make himself laff and smile really big when he sees the person, etc.

You mean like putting a bullet in someone's driveway?

I think this is DP to a T. He was probably always an immature prankster and it just grew into taking care of bigger problems. You know, like wives who wouldn't do and say what he told them to do and say.

In Session Steve Greenberg just walked into the overflow courtroom. In answer to a reporter’s question, “What’s happening?” Greenberg responds, “Nothing’s happening. The judge is going to deny our motion. And then we’ll go another two hours, and they’ll [the prosecution] screw up again.”

I hear ya. From trial to trial, I keep hoping to see a defense attorney who doesn't seem to me to be smarmy. Confidence is one thing. Smarminess is another. Watching them in front of the cameras leaves me feeling like I need a shower.

Thank you for the link. Looking above the judge's head, there is a rough sketch of Kathleen in the bathtub. If it is close to fact, it would seem unlikely she got into that position in a fall. She's all tucked in very neatly.

If she fell in the tub, or getting into the tub, I would assume she would have hit her head on the faucet to cause a bloody injury. Even with a gash on her head, she could have moved so as not to drown in a millisecond unless she passed out from the injury.

That's the crux of murder vs. fall. Prosecution, get into the science of this and stop messing around.
