How silly of me - I thought today was Friday! It's going to be a long weekend.
:spit: The "more" Emoticons not working for me!
No problem, Cubby, we'll raise your bail!!! :rocker: Edited to add: If you or anyone else here goes to the trial - sure would like your impression on the expression of the Jurors when they have to leave the court room!! Especially the first one of the day!!!
No, problem! I'm going to go back and do a count!
Sidebars for Friday, August 17th
Defense - 4
Prosecutors - 2
Judge - 6
Total Sidebars: 12
Pop-Tart Jurors - 4 times; The first one happened 11 minutes into the morning session; and a Record - 2 minutes after coming back from lunch, they are "pop-tarted" again!!
Okay, off to count the times the jurors left after Sidebars...
I have to agree with you. I don't think this judge is acting appropriately, seems to fly off the handle easily and is just not that professional. He leaves the bench way too much. If he has to look up statutes can he not do so while he is sitting there on the bench or have his assistant look them up for him. If this jury gets in a good half hour without being sent away from the courtroom it's a major event of the day for them. There is just something that is not right.
Some times I think the state wants is mistrial so the judge does not go to the end of the trial and just throw the whole thing out and set DP free. It appears to me that the jury will never get to deliberate this case and that is not fair to the victim. jmo
Good morning. Are we ready for another day? I'm hoping we're able to present a strong case today. I don't know if I can handle another day like yesterday!
The Prosecution has to handle an old case that was originally ruled an accident, that was not investigated properly ,that involves a policeman AND deal with a trial judge who LOST an election to the lead prosecutor.
At least they had the guts to try this case and hold Drew Peterson responsible for what he did and will probably get away with.
At least they are doing something, which is a hell of a lot more than was done for Kathy Savio all the years she put up with DP's abuse and ultimately her murder.
At least they are trying to keep this guy from doing it again ,as he did with Stacy.
They could have thrown up their hands and said ,since they had so much stacked against them ,they'd let Drew walk, but they decided to at least TRY .
I applaud them for that.
If nothing else,DP has spent the last 3 years in jail . That may be all he gets, but it's something.
If I were on the jury I would first be livid that I kept getting sent out every 2 to 4 minutes and my time was being wasted where I wasn't hearing more than maybe 30 to 60 min of testimony per day. I would note who was objecting the most and causing the disruption (obviously it's the defense when the state is presenting). I would wonder why testimony kept getting stricken and I would pay attention to all of that.
Further, I would also note the behavior of the judge and pay attention to how he is conducting his courtroom. I wouldn't be able to help notice he was chastising the state all the time and how he treated certain witnesses. This would lead me to believe the judge isn't able to contain himself and yes, I would put the blame on him (not on the prosecution team...the judge).
I would not be thinking at this point "the state hasn't proved their case," because I wouldn't be at that point yet until everything was done and all testimony had been received. However I would wonder why the state wasn't allowed to do a standard direct exam without constant interruptions every 30 to 60 seconds.
My observations would lead me to distrust the defense, and the judge.
I blame mostly the Prosecution, they've had years to get their ducks in a row, they know the rules etc. There is absolutely NO reason to screw up like they have.
They should have waited until they had a lot more evidence before they decided to try him.
The defense is only doing what they are called to do: defend their client to the best of their ability.
and I'd say they are doing a very good job so far.
So If Drew walks, it falls on the Prosecution.
JMO
Has anyone else see a Prosecution team mess up this bad?
:banghead:
This judge might as well declare a mistrial and send Drew on his merry way.
I'll be shocked if the jury convicts him.
let's be real: The Prosecution has not proved their case and that's what i'd be thinking if I was a member of the jury.
JMO.
if I was Kathleen's family i'd be very PO'd at the State.
nauseating feeling when Drew turned around and looked at the gallery. He looked at me too....he definitely sets off my psycho detector :yuck:
If he won't allow them to discuss the blue towel, or the statement to the uncle, or the placement of the body in the tub, why would he consider the 'hitman' testimony?
This is going to be one of those cases where the jury does it's best and listens carefully, but acquits. And then later they find out what was kept hidden from them, and they freak out. :banghead:
prosecution now arguing to include alleged hitman testimony, judge will allow if it's relevant...
:what: I take it all back, Judge.
I've been working on a theory here..... I'm seeing an argument that started downstairs, a Chase up the stairs. He tackles her on the stairs (bruises). She gets away, true to lock herself in the bathroom. He starts to drown her in toilet (fluid in lungs) she's pretty much done at this point. He hits her on the head to make sure. At the point he hits her, her head is already out of the water. He starts to stage the tube death as she is still drowning in the fluids that's trapped in the lungs...
Cubby,....Just my thought process and massive imagination and too much Law & Order..lol....but what if.....A perp attemping to shove victim's head into the toilet will be met with resistance. The victim is going to put up a fight to remain in a standing position and try to resist being forced to their knees. Possibly putting a free arm up to brace the wall causing abrasion or bruising to the wrist when perp uses his one free hand to grab the wrist and forcing the arm down while keeping his other hand holding the victim by the hair forcing her down. This manipulation would cause a person to bend more at the waist if they were able to lock their knees which would put their head down in almost a semi-upside down position while being forced down into the bowl. During the struggle in trying to get one's head out of the water to keep from drowning it would be possible to hit the back of the head on the back rim of the bowl when jerking to get head up to gasp for air. Also didn't I see some somewhere that there was bruising to the both shins, anterior thigh, and one of her buttocks. The perp is going to have his hands full trying to force the victims head down so he would have to use his legs/knees to force the victim to buckle their legs to get them down to their knees. During this struggle the victim's shins would hit the front side of the bowl pretty hard. The only bruises that are making me scratch my head are the 3 small bruises on her lower abdomen. There is some fixture in that bathroom that she fell on during the struggle. Possibly the water fixture on the side of the tub when he was dumping the body in. Still processing that one. I am going by the original autopsy report concerning the bruising and abrasions found. I would like to believe and hope that during this struggle that Kathleen got at least one good knee to the gnads in on DP. Finally, he had to take her clothes to cover the fact that there was a struggle because had she taken them off before getting into the tub and then simply fallen and bumped her head in the tub her clothes would have been left with no blood, no tears, no signs of a struggle which probably wasn't the case.

In Session ....“You know that females bruise more easily than males?” “Perhaps . . . I don’t know if it’s really accepted or not . . . I think you might be getting on thin ice.” “Well, I’m not a doctor.” “I’m not a bruise expert.”
So the Judge bars the State's witness because of a 3 day discrepancy even though the prosecution told the defense about the date. The defense waits for the prosecution to put this witness on the stand before they cry "foul"?
OMG!!!! I am done with this Judge. It is so obvious and he is pro defense. Speechless:what:
In Session Judge Burmila is back on the bench. Attorney Greenberg: “Our opinion is that this is obviously unreliable, and it should be barred as testimony. It’s all over the place.” Prosecutor Koch responds: “First of all, the testimony previously provided by Mr. Rossetto has always been that the statement was made in October.” Judge: “Does it say in the police report that the conversation took place at the apartment?” Koch: “No, it doesn’t.” Judge: “Does that police report say that it happened at Denny’s?” Koch: “It does.” Judge: “And you sent them an e-mail that said that the witness would testify consistent with that police report?” Koch: “It’s our position . . .” Judge: “STOP! I’m not asking you to spin it, or put your interpretation on it . . .” Koch: “It says that he will testify consistent with the police report . . . this particular e-mail was sent due to the continuing duty to disclose . . . the e-mail was [sent] Aug. 15 . . . basically, it comes down to the word ‘report,’ which should have been ‘statement.’” Judge: “I know the spin you want to put on it . . .” Glasgow joins the discussion, blaming the confusion on a Scribner’s error.

I'm glad i'm not on the jury.
I bet they are thinking "where the hell did this prosecution team come from".
I doubt I'd be able to convict if I was a member and I'm not going to be upset with them at all if they don't convict Drew.
very very sad for Kathleen's family and friends

I thought there had to be no blood in the tub as water would have washed it away if the gash came first. Water was in her lungs but the blood apparently did not mix with any water based on the stains in the tub. That's how I am trying to fit the pieces.
