5/7/19 Update: Prosecutors formalized the statements they would like to introduce from Dylan in a document that details what the boy said to others about his relationship with his father. The document, as ordered by 6th Judicial District Court Chief Judge Jeffery Wilson, cites evidence contained in hundreds of pages of discovery. Wilson must now review Dylan’s statements & decide whether 13 conversations the boy had with 10 people before he died will be permitted at trial.
5/22/19 Update: Sixth Judicial District Court Judge Jeffery Wilson will allow evidence obtained by sniffing dogs at trial, despite the defense’s argument that such evidence is unscientific and unreliable. Wilson said in his order that he will allow the defense team to present further arguments and evidence at an upcoming motions hearing about why cadaver dog evidence shouldn’t be allowed at trial.

So. Go ahead and exclude the cadaver dog evidence. He'll still be convicted based on the overwhelming circumstantial evidence that is compelling! Oh, of course. A change of venue will be a must. That won't change the outcome one whit.

Sixth Judicial District Court Judge Jeffery Wilson said in May that defense attorneys did not persuade the court to disallow cadaver dog evidence, upholding a prior decision despite new arguments.

But he gave defense lawyers an opportunity to present further arguments and evidence to demonstrate the unreliability of cadaver dogs.

Those arguments are being presented this week, with Redwine’s defense attorneys Moran and Justin Bogan inviting the Innocence Project attorneys to convince Wilson of the dogs’ unreliability.

Molly, a cadaver-sniffing dog from Wisconsin, alerted her trainer Carren Corcoran to the odor of human remains in 2013 and 2014. The dog alerted on clothes Redwine was wearing the night his son went missing, according to law enforcement. Molly detected the odor of human remains at Redwine’s home near Vallecito Reservoir, in the bed of his Dodge pickup and on Middle Mountain Road north of the reservoir where Dylan’s partial remains were found in June 2013.

Molly, a single-purpose cadaver dog, identified the scents nine months after Dylan’s disappearance. Prosecutors, in part, hinge their case on the fact that cadaver dogs “indicated that a deceased person had been in (Redwine’s) living room and bed of his pickup truck ... ,” according to the indictment.

Does anyone know of the reasoning the judge gave for accepting the cadaver dog evidence? I've seen the document the defence submitted to dismiss it but nothing official as to why the judge still allowed it.

The judge has not made a final decision about cadaver dogs evidence being admissible.
The judge agreed to allow the defense to bring forward more arguments against the acceptance of cadaver dogs as evidence. So the judge still might disallow it in future rulings.

Thanks, trying to get my head around the legal rules. The trial is not until later this year and they are having a series of hearings now?

It seems a long winded way to go about it. Maybe because there is so much evidence? In the Bianca Jones case they had one evidentiary hearing for the dog alerts...if I understand it correctly.

Well, it's better to get all the issues resolved before the trial, rather than have MR win on appeal because he wasn't allowed a fair defense. Still, we are getting closer to having our day in court.
