Boston bombing trial: The media is frustrated by the many restrictions imposed in the Tsarnaev case

"...local court reporters say they have never faced the sorts of restrictions imposed by Judge George O’Toole in the case of Dzhokhar Tsarnaev, the suspected Boston Marathon bomber. The bulk of the filings in the case are under seal – including at least one defense motion that was excerpted at length by the Boston Globe before the judge sealed it last week – and reporters are excluded from seeing or hearing much of the courtroom discussion that would customarily be public...."

The 13th Juror: When picking a jury turns into a marathon

"...It's a cornerstone of our legal system that a person is presumed innocent until proven guilty. So the proper answer to any question about Tsarnaev's guilt at this stage is simple: He's innocent....

It's hard to argue with all the surveillance video: the footage of the brothers with the backpacks near the finish line, the images of them in a gas station after a car-jacking, the footage of police rousting Dzhokhar Tzarnaev from the boat.

But it's flat-out wrong to say in front of a room full of people that Tzarnaev is guilty. If you do, you have no business being on his jury...."

http://www.cnn.com/2015/01/29/us/dzhokhar-tsarnaev-trial-13th-juror/index.html
---------------------------------------

BBM I do believe in this statement. I really don't know too much about the bombing except what was shown on the TV when the bombing happened and that they did find Mr. Tsarnaev and his brother, but I don't actually know what the evidence is that they have to convict him.

So- I'll find out, just like the jurors. Should be interesting, IMO.

Juror saying would be hardship, her husband travels for work: She's apparently a farmer. “I have 21 chickens that need to be taken care of”

Milton Valencia @MiltonValencia · 56m 56 minutes ago
Another issue is commute, she lives far away and it takes a half hour just to get to commuter rail station. Got up at 4 today.

She also volunteers as a chapter leader for a group that promotes natural food, open use of it such as raw milk.

So judge keeps making me and @shiraschoenberg leave courtroom for sidebars. At least it's helping with my Fitbit goals.

Milton Valencia @MiltonValencia · 22m 22 minutes ago
Heard a lot of media before trial. “It’s kind of hard to set that aside and isolate the evidence.” He’d pay attention to new info, though.

Milton Valencia @MiltonValencia · 18m 18 minutes ago
No automatic decision either way on death sentence, but “If it’s a very heinous crime, I may lean toward the death penalty.”

Milton Valencia @MiltonValencia · 12m 12 minutes ago
Juror saying death penalty not appropriate here, but, “I haven’t made up my mind because I haven’t heard all the evidence in this case.”

Milton Valencia @MiltonValencia · 11m 11 minutes ago

Shira Schoenberg @shiraschoenberg · 1m 1 minute ago
#tsarnaev fidgets with hands, writes on legal pad, touches his face as jury questioning continues

Milton Valencia @MiltonValencia · 1m 1 minute ago

Dzhokhar Tsarnaev Is Smart to Plead Not Guilty
Why the alleged Boston Marathon bomber’s plea is not as crazy as it may seem.

"...Without a deal, former federal prosecutor George Vien says he’s surprised Tsarnaev is pleading not guilty. “Oftentimes people will plead guilty in the guilt phase and then try to use that as a mitigating factor that they’ve accepted responsibility and have remorse for what they did,” Vien says..."

The best chance to save the life of Boston Marathon bombing suspect Dzhokhar Tsarnaev might be to put his dead brother on trial.

When Tsarnaev's case begins, his lawyers are likely to pin their hopes — and the bombings themselves — on his older brother, Tamerlan: a Golden Gloves boxer, college student, husband and father who also followed radical Islam was named by a friend as a participant in a grisly 2011 triple slaying.

...Under the federal death penalty law, juries deciding on a sentence can consider whether a defendant "was under unusual and substantial duress," regardless of whether duress is used as a defense to the charges. If the defense is allowed to use evidence of Tamerlan's possible involvement in the triple murder, they could argue that Dzhokhar was under duress to participate in the marathon bombings, Hoose said.

"If they can show that the older brother is gruesomely involved in the murders, all the more reason that Dzhokhar felt that not only is he my brother — he is someone not to fool around with. I have to do what he says,'" Hoose said.

Should be an interesting defense. I hope it is somehow informative about the Waltham murders but not holding my breath.
