Lawyers may file juror misconduct motion after revelations jury watched news...

Legal experts say that while it's too early to talk about potentially throwing out the verdict, this could at least lead the defense to ask for a chance to question jurors about their exposure to news coverage and whether it affected their decisions.

If it is found that the verdict was influenced by this information the conviction could be overturned or a new trial could be ordered by the judge.

University of Dayton law professor Thaddeus Hoffmeister said Guzman's lawyers will have to demonstrate not only that there was juror misconduct but that it had a prejudicial impact.

He said: 'The challenge now becomes for the court to determine whether this somehow influenced their decision making.'..."

Could Chapo actually get a new trial? Legal experts I spoke w/ said it’s absolutely possible. Like everyone else, Chapo has a right to an impartial jury. If it can be proven the jurors in his case were exposed to outside info, it could pose a real prob for the gov.

It’s one thing to have actively sought out info on the trial, looked up articles on a smartwatch INSIDE the courthouse (!), and taken notes home, but the jurors would not have been subject to arrest for unwittingly coming across coverage of the case.

"WASHINGTON — Two sons of notorious drug lord Joaquin "El Chapo" Guzmán have been indicted on drug conspiracy charges, the Justice Department said Thursday.

Joaquin Guzmán Lopez, 34, and Ovidio Guzmán Lopez, 28, are charged in a single-count indictment that was unsealed last week in Washington.

Prosecutors allege the two brothers conspired to distribute cocaine, methamphetamine and marijuana into the U.S. from Mexico and elsewhere in the world from 2008 to 2018. They are both thought to be living in Mexico and remain fugitives...."

It's important to remember how much of a hypothetical this is. Chapo's sons have not been arrested. However, the indictment unsealed last week, around the time of Chapo's conviction, and today's announcement by @TheJusticeDept is certainly timely. This is from the indictment.

"The shop in Sinaloa, Mexico, is selling Joaquín Guzmán-themed merchandise

The owners of San Jesús Malverde started selling the items when El Chapo was in the middle of a three-month trial that found him guilty of 10 counts

A figurine shows an El Chapo lookalike wearing blue jeans and pink shirt that is covered with a black bulletproof vest with grenades attached to it

The figurine, whose face is adorned with the drug kingpin's thick mustache, also has the miniature El Chapo carrying a machine gun and a radio

The store also sells beads with El Chapo's picture and a baseball cap with the initials JGL for Joaquín Guzmán Loera...

The store also happens to be the site of a shrine that pays homage to Jesús Malverde, known as the 'Saint of the Narcos' and protective figure of the poor masses.

Some folks have likened El Chapo to a Robinhood-like figure who took care of the poor people in his community.

According to a store employee who also happens to watch over the shrine, residents have stopped by to pray to Malverde for El Chapo's well being.

'Because of what is happening right now, many people come to ask him (Malverde) to give him peace of mind, to give him strength, to endure everything that is happening,' Jesús González said, according to the Diario of Yucatán."

"Almost immediately after a federal jury in Brooklyn convicted Joaquín “El Chapo” Guzmán on all 10 counts of his indictment, the Sinaloa cartel leader’s lawyers vowed to appeal the unanimous guilty verdict. Now they have formally told the judge they plan to seek a new trial, citing a report from VICE News about alleged juror misconduct as the basis for the request.

In a letter sent Friday to Judge Brian Cogan, El Chapo’s defense team asked for additional time to prepare as they make the case for a new trial. The letter characterizes the Feb. 20 VICE News article as stating “that multiple jurors engaged in misconduct by intentionally violating the Court’s direction” to avoid media coverage of the trial and not to communicate with one another about the trial prior to deliberations.

“Mr. Guzmán intends to file motion for a new trial based on the disclosures in the article and to request an evidentiary hearing to determine the extent of the misconduct,” defense attorney Eduardo Balarezo said in the letter....

The defense typically has two weeks after a guilty verdict to request a new trial. The letter from Chapo’s lawyers seeks an additional 30 days to prepare. The letter says the defense “has sought the government’s consent” for the extension, but “the government has not responded as of the time of filing.”

Independent experts who spoke with VICE News said a new trial is unlikely but within the realm of possibility, if the defense can persuade the judge that the jurors were exposed to news coverage that influenced the verdict....

"MEXICO CITY — Mexican President Andres Manuel Lopez Obrador said Friday that he has instructed his government to assist the family of Joaquin "El Chapo" Guzman in seeking humanitarian visas to visit the convicted drug trafficker in the United States.
During a visit last week to Guzman's hometown of Badiraguato in Sinaloa state, a lawyer passed Lopez Obrador a letter from Guzman's mother.

"Like any mother asking me for support for her son," Lopez Obrador said.

Guzman's mother asked for legal help and assistance obtaining humanitarian visas for two of Guzman's sisters to visit him...

A reporter had asked Lopez Obrador about reports that Guzman's mother asked him to arrange to have the drug lord serve out his sentence in Mexico, but the president did not respond directly.

In an interview with Univision just before Lopez Obrador's visit, Consuelo Loera, Guzman's mother, said, "My request is that they let me go see him and that they transfer him here to Mexico."

U.S. support for such a request would be extremely unlikely considering Guzman has escaped from two prisons in Mexico...."

"NEW YORK -- Claims of jury misconduct in the trial of drug lord Joaquin "El Chapo" Guzman have drawn new attention to the digital-age challenge courts face in preventing jurors from scouring media accounts or conducting their own research before rendering a verdict. It's a phenomenon that has been called the "Googling juror."

"Everyone has the world at their fingertips," said Guzman defense attorney Jeffrey Lichtman. "Twenty years ago, you didn't have to worry about that."

Lichtman told The Associated Press on Thursday that there are now serious questions surrounding Guzman's conviction this month on drug-smuggling and conspiracy charges, and that he plans to ask U.S. District Judge Brian Cogan to bring in all 12 jurors and six alternates to question them about reports several flouted admonitions to avoid media accounts of the case....

"It's clear we have to get them back into court and get some answers about some massive misconduct," Lichtman said....

...the juror who spoke with VICE News said five jurors involved in the deliberations and two alternates had heard about child rape allegations that had been made against Guzman and covered by the news media but not admitted into the trial. The juror also described an instance in which a juror used a smartwatch to look up a news story just moments after Cogan met with them privately to ask them whether they had been exposed to any recent media coverage.

"This is a growing phenomenon, and courts are struggling with how to address it," said Thaddeus Hoffmeister, a University of Dayton law professor whose research has focused on juries. "You're dealing with people today who have more faith in Google than the witnesses being called to testify."..."

"Joaquin “El Chapo” Guzman has hired a fourth lawyer to join his legal team, following last week’s bombshell reports of juror misconduct.

Attorney Marc Fernich now joins Jeffrey Lichtman, Eduardo Balarezo and William Purpura in defending the runty kingpin, who was convicted earlier this month on a raft of drug-trafficking charges.

Fernich entered his appearance Monday, just days after a juror told Vice News they’d ignored Judge Brian Cogan’s instructions to avoid media — and even lied to the judge when asked if they’d seen certain stories.

While Fernich did not immediately return messages, his website says his professional focus is on “sophisticated appeals and legal motions that can toss charges at the trial level or pave the way for future appeals.”...

Fernich’s list of previous clients includes Gigi Jordan, the mother convicted of killing her autistic son, and various accused crime bosses.

He and Lichtman have worked together previously — they were part of the team that succeeded in getting John “Junior” Gotti acquitted in 2005 on a $25 million securities fraud charge...."

Turns out, it's a licensing agreement for a signature line of Chapo brand clothing. Literally, Chapo's signature, as a logo, on the clothes.

"MONTREAL: Canadian police said Wednesday they have seized methamphetamine worth more than US$3 million (RM12.2 million) smuggled in by the powerful crime syndicate once run by feared Mexican drug lord Joaquin “El Chapo” Guzman.

Officers in Ontario were alerted to the 180-kilogram haul by a car dealership that discovered the packets in tires that did not match the make and model of the Ford Fusions being shipped.

Police believe Guzman’s Sinaloa Cartel, which controls the area around the Ford manufacturing plant in Hermosillo, Mexico, was behind the shipment, valued at Can$4.5 million (US$3.4 million)...."
