Well, Texas needs to file charges against her. If they've got Det. Salame's recording that allegedly EJ confessed to killing Gabriel to him, then they need to file murder charges against her. Period.



I heard somewhere that her confession couldn't be used or something like that(correct me if I'm wrong) due to something to do with her rights being violated. I hope Texas can get it together enough to press charges though.

You bring up a good point artsy . . . since she confessed to murder in Texas . . .it would appear if they could prove more likely than not she did in fact suffocate Gabriel they would be able to file further charges. Texas is not known to be "kind" toward convicted murderers.

I am wondering why Texas never searched the landfill - given they had a reasonable time and date and location of the trash that she confessed to throwing her baby boy into.



It's been so long ago, but I seem to remember they did search the landfill but it was days or weeks after the fact.

That's the problem with this case. The defense will put on little if any case. They will just say that Logan didn't have any custody rights when EJ took him to Texas. That was also part of Tammi Smith's defense. It didn't work there and I hope it doesn't work in this trial.

Artsy, I'm in total agreement with you. I wish Texas had a case to work with. Unfortunately, we don't know what happened to Gabriel. EJ is pure evil no matter what happened.

a Maricopa County Superior Court judge ruled that another reportedly similar statement Johnson also made to a San Antonio homicide detective would not be heard when she goes to trial in September.

. Also previously leaked to an Arizona news station was a recording of San Antonio homicide Detective Jesse Salame confirming Johnson confessed during a May 2010 interview.

It was that interview that violated Johnson's sixth amendment rights the judge ruled on Monday. The ruling resulted from a motion to dismiss Johnson's previous attorneys filed in October 2010 accusing Salame of violating her right to counsel, disparaging the attorneys, threatening her with the Texas death penalty and touching her arm and leg while speaking with her.

However, two law enforcement officers at the jail said in a sworn affidavit that neither of them saw Salame touching the defendant nor did they hear him threaten Johnson with death row, according to court documents.

Just a quick note . . . I do not profess to accurately transcribe each and every word . . . I just try to catch most of the conversation and the "gist" of what is being asked and answered. This is mostly for those folks who cannot watch and do not have access to video to see how things went down in court. Please . . . If I got something wrong or it doesn't sound quite right . . . correct me so that others can have the benefit of all of you observing and listening as well. Sometimes I get lost and don't finish a thought (trying to catch up) or I lose feed and have to switch channels and miss some testimony.

IIRC- Elizabeth arrived in San Antonio with a phony TX license. To me that suggests she left AZ with the intention of never returning. If she planned that before she left, it could go a long way on the kidnapping charge.

That was an AZ ruling though. Might go over differently in TX if they can get a ruling like Kreamer made when he said statement to FBI can be admitted, because looking for a missing endangered child overrules Miranda....

Since Salame is from SA where Gabriel went missing, I'm thinking they could get a similar ruling there. JMHO

Let's hope they can do something because IMO I doubt she will get a long enough sentence if found guilty of these current charges not to mention that she might get off due to custody issues. Hope I'm wrong.

You and me both. TPS only got 30 days for custodial interference, the witch. EJ has the added kidnapping charge though, so that might be it.

Its back on. Note from Juror stating he would like to take a afternoon next week to take care of a work issue. The attorneys are at the bench looking at the note and discussing.

Defense will not be cross examining Logan . . . moving onto the next witness in this case. (OT . . . wondering if EJ got to eat lunch today or if she had to bring part of her breakfast and a power bar with her?)
