Emergency Hearing 12/16/08 UPDATE: Motions Denied

  • #101
I would anticipate the the judge will hand the Scheme Team their a$$es for their grand-standing. They are entitled to exactly nothing until the official identification has been made. And in case it has escaped their notice, that is at a federal level now, since the identification is being done at FBI labs, and is not a case of the Orange County LE playing games or dragging their feet.

I wonder if he can charge them with contempt for harrassing the court after he's specifically addressed this issue already. He said he would allow them acces to the photos and videos AFTER LE made a positive identification of the body -- not a preliminary. That's what I heard him say at any rate. :)

I heard beth karras on court tv say remains of "a little girl". I didn't think they had even leaked the sex of the small chilld remains - is this new? Also, maybe they found the missing blackjack phone of kc's in with the remains. . . . hmmmmmmm . . . . . .

I doubt if LE will allow JB to do any kind of search in the woods or a autoposy until they have finished doing thier search of the woods and finding all the evidence in the woods and the Anthony home.

Should be interesting! Perhaps the judge is a little miffed that the Defense showed up at the crime scene the other night. I saw on the news that H Lee had a camera that day taking pics in the direction of the investigators.

AND he was on NG last night. Just what the SP said he would do.

until then, i would hope the court would say "jb, if you are willing to say that you have talked to your client, and that your client has told you that she knows these are caylee's remains, and that you are willing to stipulate to the court that your client has knowlege of these remains being caylee, that you stipulate that your client has knowlege of the circumstances that led to caylee's remains being found in this place" then the court will agree to give you certain amount of the known evidence on this crime scene.

amen mysteriew!

I must admit I don't know the first thing about lawyer etiquette, but I found JB showing up with his defense team the day after the motion was denied for them to be at the active crime scene unprofessional and irritating. What was more irritating was that they brought along so-called "forensic experts" that tried to have access to the crime scene and gave heated interviews with the press over how angry they were that they weren't allowed to view the crime scene and how unprecedented it was not to allow them to be present to observe the investigation - "Don't you know who I am??? I am an expert in my field!!"

I am wondering if LE or FBI feels the same way. I realize that they were standing where the rest of the media were, but I just found the whole thing intrusive, and now this latest emergency hearing. The whole thing just leaves a sickening feeling in my stomach. No one cares about Caylee. What happened to justice for Caylee? Ugh.

I would certainly hope that Judge Strickland would slap them down and tell them to stop wasting the court's time. This is rediculous!! :furious:

"The hearing was scheduled for Tuesday afternoon after Anthony's defense team filed several new motions, calling for the prosecution to turn over photographs, video recordings and drawings taken at the scene where the remains of a small child were discovered Thursday."

and

"The defense has also asked for a second autopsy on the skull found among the remains."

because

"Baez said he wants his own experts to examine the remains, and fears the FBI could destroy that evidence after the remains are identified."

when:

"The hearings are scheduled to be heard in front of Judge Stan Strickland at 2 p.m. Tuesday. Watch the hearing LIVE on News 13."

Wait! Once the remains are identified as Caylee, they are returned to the FAMILY for a proper burial or cremation. It is up to the family to do this, NOT the FBI or other LE agencies.

Generally, the remains would not be retained as evidence unless further forensic testing is necessary. I'm pretty sure this is the way it goes...

I agree, it's totally unprofessional and insulting for JB and the Scheme Team (I really like that name, btw  ) to do what they're doing.

As for Justice for Caylee, LE is doing all that they can to ensure that she is given the justice she deserves. They are being so careful out there, and dotting every I and crossing every T.

I hope the judge throws a contempt warning at JB - does he really think the FBI is going to impune its reputation over one murder in FL? This isn't a national security/gang/mob case where anyone would be tempted to destroy evidence or anything (on the FBI side) to ENSURE a conviction...

No disrespect to Caylee or the case, but I mean there are no other lives on the line that would lead to the possibility of sloppy/rushed/fudged police work to get the conviction. Know what I mean? JB thinks he's hot stuff IMO

Next he'll be calling the fire department because his defense is going down in flames.

Next he will file an emergency motion to appoint a member of his team as the judge and members of his team as the jury because he is afraid that there will be a mistrial.

Incredible.

AND if he is so worried about things being compromised, his "dream team" of experts-for-sale could surely discover that once they get the evidence, and then question LE about it DURING the trial. There also are separate crimes of "official misconduct" that usually deters even the most corupt officer/agent from actually interfering IN a case. Not that I think there WOULD BE any of that here, but just to keep in mind there are additional protections for the defense! JB needs to relax

Nice catch. "... will be delivered under the normal course of discovery."

I had to read it a few times to make sure I wasn't missing something obvious, but yeah...he actually put that in his own motion. :waitasec:

I don't understand why JB thinks he's allowed to do this? Honestly, in a murder case the forensics team has gathered and removed all of the evidence before they even have a suspect in custody. Just because the order is reversed here, I don't think it grants special privileges to the defense, does it? It just seems to be basic Law 101 that the FBI & Investigators from the governing jurisdiction are the ones who examine and secure a crime scene...not a 3rd party crew hired by a Defense Attorney.

It's almost embarrassing at times.

You know that raises another whole issue for the Anthonys. Do they want to put the baby to rest after this ordeal or do they turn the rest of her poor body for more desecration in the hopes of finding their daughter not guilty?

It's usually the defense that accuses LE and Prosecutor of "Rush to Judgement" and here we have JB and the gang giving them the bums rush. LOL Can't just blame this Emergency hearing/waste of taxpayer's money on JB now that LKB is on the team along with the slew of other cast members. They should know better.

Ha, ha. Now stop stealing JB's notes. He needs those.
