Emergency Hearing 12/16/08 UPDATE: Motions Denied

  • #261
Sometimes I get tired, feel my eyes start to close and my head start to fall to my desk when I'm listening to Baez. Maybe it's just me...or maybe it's cause he's monotone and not the most compelling?

It's not you, it's the Baez babble.

I hope this judge says "You'll get access to the scene WHEN LE is done with it, that maybe be 1 day or 30 days that's how it goes it's an on going investigation"....WTH is he thinking.....if they were still investigating her & she had no been arressted yet...he would have NO leg to stand on to haev ANY access to the scene!

I would like the judge to say "You will have to wait 31 Days to access the scene!!!"

2nd autopsy moot? Is that what he said

  • #264
I tried to watch JB he just rambles! Talking about the article from Dr. Lee about forensic botony - for the court to read at their leisure - geez!

I'll read your guys updates - I have sincere respect for this judge he's has to listen to JB just ramble and the new lawyer Baden argue things that come out of the darn movies! She's already blaming the FBI for something they havne't done!

What did the court say was moot and would not entertain?

(Atty for ME)"will be in the process, 3 inches of bone loss, involving maceration, but no plans to do anything diffweent than normal, minimum amount sent for id purposes, feel that dr g has a responsibility to carry out duties, she is a pro (dr G) and there has been no suggestion that she waoud do anything untoward, she should be allowed to conduct official duty, and when she is done, remains will be turned over to next of kin...Minimum amount of bone loss amount necessary to get results for ID and toxicology review...

  • #267
The M.E. does not want "strangers" in her lab. Per Dr. G. Nicely put!!!

  • #268
Dr. G no intent to mascerate the bones, there will be about 3 inches of bone loss that could involve maseraction. A minimal amount of remains have been sent for ID to Quantico. Dr. G is a professional that has done this for years, no indication she would do anything untoward. When she is complete the remains will be turned over to next of kin, second anyasis can occur at this time. She doesn't want strangers in on her exam due to the nature of her responsibility. The three inches will be not only mascerated but destroyed. It is the amount neccessary to be tested.

I am pretty sure that this judge just denied everything.

Judge SS - Motion to preserve - he can't instruct the FBI what to do. 2nd autopsy MOOT.

Talking about JB's experts at the scene making LE work even harder (my words). LOL

I can't assit you in a murder investigation. They (LE) are intitled to get what they need. THere is no requirement of the law to allow the defese to be there. I can't interfere with LE or the ME.

Other items will be set in the due course of the discovery. Autopsy is MOOT but will be discussed at another time.

MOTIONS DENIED

Blond OSCO chic - the person taking photos are sitting in the dirt right now. Can't give a time line on the work they need to do.

Judge - Unusual that the body found after charges so this is a unusal situation. Please give him what he needs asap.

Sound off again as they all approach the bench???

Sound back on - trying to evesdrop... LOL

"I can't assist you in interfering with a muder investigation."

DOH!

  • #274
As I said at the last hearing that JB request.... why the heck does he think he and his team should be allowed to investigate a murder??? Its LE's job to investigate a murder. The judge ruled just like I thought he would. JB needs to talk to his client and get the truth out of her if he wants to know what is going on! And then wait just like any other defense attorney to get discovery.

JB just got whupped in Court!!!!!!!!!!!!!!!!

  • #276
The defense is the only one taking this seriously ~ per JB
It goes to the heart of the situation, if the defense doen't have the abilty to observe it ruins KC"s right to a fair trial.

AMD OCSO - Not a motion to have access to crime scene. As more is found the crime scene being released is taking longer. We are working an active crime scene, NOT a excavation site. No need to release photos and videos yet, still an active investigation.
We are willing to help them get into the scene asap, JB can make a public records request. We will not release pics of the skull even beofore the body has been identified. We'll give photos that are irrelevant, we aren't in aposition to release all of the photos at this time.

I swear JB has been around KC too much. This sounds exactly like something she would say.

the judge basically accused the defense of interfering in a murder investigation! haha

  • #278
Judge Strickland is "Tha Man!"

  • #279
LOL, DENIED! as it should have been. These motions are ridicules. They can't interfere in a investigation. JB needs to file a motion for a delay in the trial if he want to get something approved.
