The following is a science based editorial about another of BCH's controversial cases where they removed the child from the parents and the changed the treatment. It isn't about the case here, but I think it fits this case extremely well, and everyone should read this to understand both sides of the story better.

An good read, and good discussion under it. Thanks for the link.

I don't know what it's about, and neither does anyone else here. There are untold numbers of possible diagnoses and names for situations that might cover Justina and her family. We do not know, and that is the point. People are jumping to the most extreme conclusions (Children's being involved in testing, or conspiracies with DCF, a nationwide push to erode parental rights, etc etc) without knowing fully half the story.

Why the gag order? Speculating, possibly because this girl's medical information isn't/shouldn't be public information?!

The Government had hospitals and doctors doing testing on children Florida .They were all under DCF/CPS foster care. I had stumbled upon this when I was looking into something else. Our government has also experimented on our soldiers. When they gave the Black soldiers syphilis in the 1930's the doctors and hospitals all knew they were exposed but not one of the soldiers was ever told.People died, babies were born with birth defects. They all kept that secret for over 50 years IIRC. God only knows what they are doing behind closed doors. These giant hospitals get millions and millions of dollars from the government.

Thanks, I'm aware of the Tuskegee experiment.

Leaving aside that this is not the south in the 1930s, that Children's is not an arm of the government, etc - my point is simply this: is there no room in your imagination for possibilities besides the most extreme one (ie, that Children's, the judge, DCF, all the doctors are involved in a large conspiracy to experiment on Justina)? Especially knowing that we have only half the story? Is it possible, to some of you, that something else is going on here besides the most nefarious possibilities?

Because yeah, i suppose the remote possibility exists that there is a big conspiracy going on to experiment on Justina, or to take away parental rights. Is it likely though? No. And is it rational to jump to the most extreme conclusions not only without evidence, but without the whole story? Again, no.

verified boston globe reporter twitter account - is that allowed?

facility that she was supposed to go to may be backing out, there was an organized effort to call and harass them so that may be playing a part.

judge was open to discussing returning justina to her parents care with conditions.

Patricia Wen (globepatty) is a journalist and one of the writers of the initial Globe articles about the Pelletiers and Boston Children's. What i find appaling, actually, are some of the replies to her recent tweets about the hearing and about the case. I guess I just come from another time, another place.

I thought the following tweet was interesting since i hadn't previously seen anything about this possibility in this most recent hearing, that the judge was open to returning the child to the parents (with conditions). That was not reported or leaked by any of the vultures that have gathered around the Pelletiers.

"Source briefed on case baffled why parents of #justinapelletier so upset when judge in court Mon. said open to returning teen to them in CT"

Also, why did the mother wait to collapse outside the courtroom and not inside? Just wondering.

I think her parents believed she would be returned immediately. Right or wrong, they do not have custody of their child. That has to be emotionally overwhelming beyond belief.

Good grief. This is why it's bad for media outfits to fan the emotional flames, and for folks to jump to the worst conclusions. This is the result.

I hope this doesn't impair her progress.

This is a travesty. If the state takes a child away, the parents have the right to know what they're accused of, and have the right to face their accusers.

And then, they have the right to be able to speak publicly about what is going on. All this done in darkness with the parents having no idea what they're accused of is illegal.

Prayers that the new legal team will at least be able to provide transparency to the family so they can understand what child abuse they're accused of.

Exactly! A year in state custody and she's worse. It'd be one thing if they removed the parents and the symptoms disappeared but one year later and you've got a girl so sick she's bedridden and non-verbal?

The parents have made their share of mistakes but this is insane. Asking for a second (or third, forth or fifth) medical opinion should not be grounds to lose custody.

Sorry, I'm brand-new to this case. What mistakes have the parents made?

To me, it reads like she was diagnosed with Mitochondrial disease, and was doing better with treatment at Tufts. Then she came down with what appeared to be a severe flu so they took her to Boston Children's ER for treatment. At that time, the docs decided she was misdiagnosed and didn't have MITO but in fact had a mental illness. They treated her for that for a year, allowing parental contact only one hour a week with supervision where they were not allowed to discuss their daughter's health issues and symptoms with her, and now she's been ordered to foster care.

Is there more to the story about parent's mistakes?

Thanks in advance.

What progress?

She was apparently stabilized/improved enough to be moved to the facility.

Are you privy to medical details about her that shows differently?

Taking her to Children's certainly seems like a big one.
It appears Children's is accusing parents of abuse because they have been agressive in seeking treatments for their child.

We have absolutely no facts to back up your assertion that the parents lost custody due to seeking a second opinion. I would be willing to bet my home that there isn't a judge around who would allow such a thing to happen.

Half the story, and all that, etc.

Gardenlady - are you privy to any further details? I'm not trying to be argumentative.

In cases like this, I usually say there MUST be more to the story, and there usually is. Sometimes though, there isn't more to the story and it's reported exactly truthfully and the powers in place have acted with willful malfeasance.

I would be less upset about hearing half of the story if the family hadn't had a gag order slapped on them. That just seems like an absolute nightmare - they are fighting what they see as a gross injustice and they are ordered to shut up and take it.

My assumption has always been the gag order is there to protect Justina's medical privacy. Whether her parents realize it or not, whatever is going on with her is her private medical information. She doesn't deserve for it to be plastered, in depth, all over newspapers, broadcast on radio talk shows, etc, as has been done. I feel terrible for her! Like it or not, there will be folks in the future who will now have access to and knowledge about her medical matters via a quick google search - it could unfortunately affect her job prospects, etc, in the future.

I also suspect perhaps the judge may have wanted I avoid some of the activist groups coming in as we are seeing now.

Just my assumptions. You know what assumptions do, though, so take them for what they're worth lol. Just seems like those are the most likely reasons.

I totally don't have any more information than anyone else here. I'm just alarmed at how so many have jumped to the most extreme assumptions as to what's going on (medical experimentation, some part in a widespread ploy to erode parental rights, etc), when we don't know the full story.
