I have been fighting CPS in NJ and I know how they work the courts I have unfortunately seen them in action. When they are involved the Judge goes by what they say, even when evidence is presented showing they are failing the children ,the judge refuses to even look at it till CPS,DYFS or whatever initials they keep changing it to.If you are out spoken in being protective about the abuse of a loved one be it from an individual or a hospitals care as in this case they will use that against you.It is horrendous when a child tells you they are being abused and you hear them being verbally attacked and know they are receiving punishments for speaking out against the abuser who then lies and say it never happened when you were there and it was said right to you.CPS has an agenda and believe me when I say 99% of the time it has nothing to do with actual protection of the child! If thee parents are a danger to their child why aren't they facing neglect charges in court? It sure seems to me that they use gag orders to shut the parents up. After I went on a writing campaign to every elected official in my state and then had a tv show who wanted us to appear that CPS finally allowed the paternal family involved in family meetings and then they wanted us to sign confidentially forms which we refused to sign. They refused to start the meeting unless we signed it.we signed because we had no choice but the meetings were BS.4yrs later the kids are still living with abusers ! CPS is just like airport security and Dept. of Homeland Security all they are is A FALSE SENSE OF SECURITY AND SAFETY IMO! And if you dare question a supervisor or ask them to please do their job and protect your loved one ,they get all bent out of shape and attack you.

"Confidentiality" is a joke. It's used as a shield for people that have something to hide.
It's not to protect the child....It's to cover their butts and hide their crap, like a cat in a litter box.

All IMO

I agree and have not let it stop me from telling about the horrendous way my grandson and his sister were treated after speaking out. No agreement will shut me up when fighting for my grandson. I wish they would sue me so I could get it in the NJ papers ! CPS/DYFS made so many mistakes and did not even follow up when the mom disregarded 3 different family plans all because she got pregnant a month after he abused her 2 children. Unfortunately she lives in Trenton and his dad lives in Monmouth County and our police dept would have handled it so different.Even our Police Chief was shocked about the way this was treated and he said in our town the abuser would be in prison by now but the abuse happened in Trenton, and told to us in Monmouth and that is why he was involved.4 years later DYFS is still making appointments every 2 weeks to check on kids.Unfounded my backside!

Parents of Justina Pelletier upset after learning teenager will now be sent to DCF foster care, advocates say

By Patricia Wen / Globe Staff / February 24, 2014
Boston Globe

"The parents of Justina Pelletier reacted with tears and shouts of anger after learning at a Boston courthouse today that the Department of Children and Families wants to place their teenage daughter in foster care on Boston’s North Shore, according to family advocates.

The parents were also upset because they were told a gag order remains in place."

*

"One issue before the judge in today’s hearing was whether Lou Pelletier should be held in contempt of court for violating a gag order. ..."

The Pelletiers’ primary attorney declined comment, citing the gag order."

*

"Mathew Staver, founder of Liberty Counsel, a conservative nonprofit legal group, said he now represents the Pelletiers in their effort to end the gag order imposed by the judge. He said the DCF was given two days to tell the judge whether they oppose allowing Staver to enter the case on the gag order issue."

Oh my. So the judge decided not to let Justina go back to her parents. Shouting, collapsing and being hauled off by stretcher, and defying a judge can't be helping them.

They were lied too, they followed what the judge asked and then to have their daughter sent to a foster home, I can fully understand the mothers frustration and her collapse.Unless a person experiences the system failing them , they have no idea how nightmarish it truly is. Judges side with CPS to protect them from law suits IMO and experience with them.

Your situation is a very very sad one...and it's just one of far far too many!

In two years my own son will be an adult. I will not become verified here until then for fear of retaliation.

What is it they say about power? Power corrupts and absolute power corrupts absolutely!

Children's might be doing something wrong here, but since they're not able to give their version of the story, I can't tell that. That being said, the fact Tufts also reported them is telling. Two of the greatest medical facilities in the world (not an exaggeration) made the same choices. Why?

  • #128
What? I haven't seen anything about Tufts reporting them.

it is mentioned in many of the articles about the case, it is definitely in the globe article.

Link? I dont' see anything of the sort in the latest globe article. Tufts is the hospital that diagnosed her with mitochnodrial disease. So what would they report the family for? Tufts clearly believes this disease exists and Justina has it, since they diagnosed her with it.

If these parents had Munchousen By Proxy, the child should have improved when she was taken from them. It sounds like she got worse. Apparently she can't even walk.
So, again, if Children's think they are the onese who diagnosed her correctly, why isn't she improving?

Munchausen is not the only possibility here.

Again, with only half the story, it's kind of irrational to be assuming anything.

i have not heard munchausen used by BCH or DCF.

according to the boston globe this morning she will be going to one of these facilities;

http://shorecollaborative.org/

and primary care is going to be transferred (upon final approval) from BCH to Umass Memorial in Worcester.

her father reported that the last time they saw her she had a bloated stomach and red lines on her stomach, which he suggested could be from a protein deficiency, a raging infection, or poison...

What is it about, then? Because of disagreement over a diagnosis, a child can be removed from the parents care? I don't understand why this is being done.
It's also very troubling to me that parents aren't supposed to talk because of a gag order. Why was the gag order issued?

I don't know what it's about, and neither does anyone else here. There are untold numbers of possible diagnoses and names for situations that might cover Justina and her family. We do not know, and that is the point. People are jumping to the most extreme conclusions (Children's being involved in testing, or conspiracies with DCF, a nationwide push to erode parental rights, etc etc) without knowing fully half the story.

Why the gag order? Speculating, possibly because this girl's medical information isn't/shouldn't be public information?!

This certainly isn't a foster home. It is another way to keep her isolated, and from reuniting with her family and community. This girl had a life of school, friends and family and they are severing her from it. How can anyone say this is good?

There is no doubt in my mind it is to protect those culpable in this case, and it is not the parents in this case, imo. People forget or overlook that this child was treated by specialists at a respected hospital for years. How can the parents be accused of medical neglect if they were following doctors orders? The bottom line here is that this should never have happened, period.

I believe the actual accusation was medical child abuse, which differs from neglect. From inferences in various articles, it seems that rather than a lack of treatment, it is believed they were subjecting her to unnecessary and overly invasive treatment.

Again though, that is just reading between the lines, as we do not have the full story.

I am glad they will be having her care overseen at Worcester. UMass is yet another well-regarded facility (really network of facilities), and hopefully as a third party to this can help diffuse suspicion/mistrust from either "side".
