Once again, Dolan trying to force the hospital into doing something unethical, against the law, or whatever in order to charge them with it farther down the road.

I think Dolan should just ask his doctor to do a little unethical and illegal surgery at the family home....... See how that goes over.

Both sides have agreed to allow Jahi to leave Children's, which was a victory for the family. But now the next question is how to get her a feeding tube.

"That issue is pending currently in the federal court where we're heading now," Dolan said. "It's also now going back to the court of appeals, and ask Judge Grillo to address it in the first instance."

It would seem that dolan is still trying to force the hospital to insert tubes with the federal filing.

I guess we can conclude from that tweet, she indeed will be going to the construction site or maybe that's what they'd like us to believe......I know longer know what to believe except I cant believe the luancy of the situation, no one wins anything here......I also think this is no longer about Jahi, the lawyer nor the mom in my opinion are being heroic, it seems to be about I am not backing down till I get my way, meanwhile all this little girl has left is her dignity, and it is being trampled all over.....Shame on them.......Where is her minister??


Yep! It's turned into a whole lot of verbal foot stomping at this point.

Christopher Dolan, the attorney for Jahi's family, asked Judge Evelio Grillo to order Children's Hospital to insert a gastric feeding tube so that Jahi can get nutrition and a tracheostomy tube that would make it easier for her to breathe while she's transferred to another facility.

But Grillo denied that request, saying that inserting the tubes is "a medical determination that has to be made by physicians."

So is the diagnosis of brain death, I presume. Why were they in court about that again?

Once Jahi's body leaves CHO, she can't be readmitted to any hospitals or health care facilities. She has a death certificate.

Do the parents get a copy of the dc? The timing is beyond strange. :waitasec:

Seems it was mentioned that the doc is not complete and won't be until after autopsy. I don't think a copy could be obtained until it is filed with state. The copy I received after my sons death came from state and bears seal.

It is unfortunate, but I do understand and respect this judge that he would not order the tubes to be put in place because it is a health care facility, she is deteriorating, they would do it under other circumstances with people who have been considered who have been considered to be brain-death. And it is sad for the family, but now we have the pathway to get Jahi to somebody who will."

and is he seriously claiming that CHO inserts feeding tubes into brain dead patients all the time under other circumstances?

Wait, that's not what the court ruled. They ruled that CHO did not have to perform the surgery or agree to have someone else come in to their hospital to do it.

Unless I was seeing things earlier? Help!

I desperately hope that some kind of media gag is placed. I admit I have NO IDEA how this could even be done but I know they can do it for people in witness protection (eg worldwide media is forbidden from publishing photos of James Bulger's killers).

Please, for Jahi's sake let someone protect her. This thought distresses me so much.

Ohhhh my, that's right. I would imagine that any paramedics/EMT's called on her behalf wouldn't have to try to save a life that was already gone (three weeks ago), either, right?
