The uncle is so full of ****. NOTHING related to Jahi on his instagram account until she died after surgery. Not ONE picture of her.

I saw her in two of his postings - a video of Jahi standing in a pool catching a younger girl (28 Sept. 13) and a pic (15 Dec. 2012) called "Mom's going down the Soul Train line." Jahi is wearing a peach top and black pants.

This is something I haven't seen posted, but I've thought about it a bit.

Jahi was an 8th grader, meaning she had school classmates. I wonder how this is affecting them.

I don't have kids yet, so I have no idea what the best course is, but I think I would keep them from any kind of news media about this. It's too confusing, and who would want to hear about a family fighting to "keep her alive" and whatnot. So distressing for kids, who may not have the capability of understand the complexities at work here, to think that a hospital is trying to kill someone and the parents are fighting for her life. I'd want to sit down with my kids and explain what happened but try to shield them as much as possible...but that's hard when they're going to school with kids whose parents may feel differently. So sad, and I'm sure there are a lot of very hard conversations going on right now.

I guess I didn't go back enough time *snort*. If you were to look at my FB, you can hardly find a week that I go by without mentioning my adored nephew. A note, a comment, a pic, a video (and heck, I do't even live in the same city). For the past six years, I have chronicled his life with love and adoration. This jerk, well, suddenly he is trying to appear as uncle of the year. I don't think so :nonono: ---- he is an opportunist.

I'd like to know the name of the facility that has agreed to take her because I'd like to know how they are obeying laws and ethics about dealing with a dead individual.

I'd research their licensing, etc and maybe look at photo to try to assess the physical plant, but I would not be driving by there, taking video of the place, or trying to interview employees.

I'm more interested in finding the truths about what is or isn't being done and how it complies or doesn't with the applicable laws and ethics.

Dolan has denigrated CHO so vehemently and persistently, without merit IMO, that I would want to see if and how he is complying with the agreements he and the family made in court.

Do families have rights to determine when a hospital unplugs the ventilator in cases of brain death?

No, only to a brief period of accommodation. California Health and Safety Code Section 1254.4 states: “A general acute care hospital shall adopt a policy for providing family or next of kin with a reasonably brief period of accommodation…from the time that a patient is declared dead by reason of irreversible cessation of all functions of the entire brain, including the brain stem, in accordance with Section 7180, through discontinuation of cardiopulmonary support for the patient. During this reasonably brief period of accommodation, a hospital is required to continue only previously ordered cardiopulmonary support. No other medical intervention is required.”

The statute defines a “reasonably brief period” as “an amount of time afforded to gather family or next of kin at the patient's bedside.”


Did the Jahi McMath case change case law in this case or is it likely to do so?

No.

The Alameda County Sheriff’s Coroner’s Bureau was notified by Children’s Hospital Oakland of Jahi’s death on Dec. 12. The Coroner’s Bureau issued a death certificate Friday, Jan. 3.


What about an autopsy?

Jahi McMath’s death is the type of case that falls under the jurisdiction of the coroner’s bureau. However, by statute the coroner has discretion to determine the level of inquiry to be conducted. Since the body has been released to the family it is possible that there will be no autopsy.

Can maintenance of cardiopulmonary functions by a ventilator affect the ability to determine cause of death during an autopsy?

It can. But that depends on the cause of death. The ventilator can cause changes in the body that in some cases can make cause of death difficult to determine.

I still can't get my head around the ethics of this:

"Nurses and doctors are working to stabilize her..."

But that can't be true, can it? Wouldn't ANY medical professional lose their license if they "worked" on Jahi's body in any way?

Can a medical sleuther explain the ethical/hippocratic situation to me? (Not trying to be a pain, I just don't understand.)

Like I said, he'll be happy to plead for privacy for Jahi on TV, just make sure and spell his name correctly on the check.......

Why didnt they do more when she was heavily bleeding? Has anyone speculated on this?

All the time I thought it was Top Secret Life Loving Care Facility and they actually sent her to Top Secret Tender Loving Care Facility of Love.

Just as long as they didn't send her to New Beginnings Office Complex.

I feel sorry for her friends AND the poor LIVING children and their families in the hospital at the same time as her. They not only had to deal with the stress of their own illnesses but the circus that this selfish family created. If I was lawsuit-happy, I would suggest that the families there sue the Mcmath family for disturbing the peace of the hospital and prolonging recovery of living patients due to the stressful environment. If the Mcmath family can make BS claims, so can every other family in that place.

Dolan could be using the term "doctor" rather liberally, and it could be a chiropracter, a DDS, a naturopath, an optometrist, a veterinarian.......

or even a Doctor....of Science!

There have been other cases where brain dead persons were kept on ventillators for as long as possible. As far as I know nobody lost their license over it.
I am not sure why this case would be any different.
