Lee Bentley, III announces the return of an indictment charging Jorge Guerrero-Torres (28, Orlando) with possession of child and production of child . If convicted, he faces a maximum penalty of 20 years in federal prison on the possession charge, and minimum mandatory sentence of 15 years, up to 30 years, in federal prison on the production charge. Guerrero-Torres was arrested and made his initial appearance in federal court on June 6, 2016, in Fort Myers. He remains detained pending further proceedings
An indictment is merely a formal charge that a defendant has committed one or more violations of federal criminal law, and every defendant is presumed innocent unless, and until, proven guilty.
This case was investigated the Lee County Sheriff’s Office, the Florida Department of Law Enforcement, and the Federal Bureau of Investigation. It will be prosecuted by Chief Assistant United States Attorney Jesus M. Casas and Assistant United States Attorney Charles Schmitz.

I could be wrong, but I believe it says in the arrest affidavit that it's considered federal/international because the Samsung phone was manufactured in China.

Thank you - So it does (page 7 of 7, item #19). I remember now thinking that was odd and perhaps a weak argument when I read it (but I have no idea why LE sometimes does what they do).

There are probably multiple strategic reasons for their decision to charge this federally, and more power to them. Maybe JG is involved in something bigger, maybe DA is alive somewhere, and maybe JG will talk with these heavyhanded charges against him, 30 years in a federal prison followed by deportation is almost his whole life.

I will need to read that Indictment about 5 or 10 more times, but Count One in Orange & Lee Counties seems to pertain to the possession of the CP, and Count Two in Lee County seems to pertain to the manufacture of the CP. So, yes I agree with you, they may have developed information that it is DA in the photos, meaning this abuse has gone on a long time. Doesn't DA have a scar(s) on her (left) leg?

I love black & whites, they are my favorite, they feel concrete.
especially in this case, as it's the only thing that I feel I can trust.

I'm praying LE has a carefully executed plan.
I remember when FMPD was investigating the Seiver's case; they got real, real quiet before charging & arresting her husband. I'm hoping the (what feels like) thousands of news sites who all reported that the physical search for DA is over we're all told to do so by LE; like they want everyone to relax while they make moves in silence.

In that post, Jen Darme provides a map of Florida counties where local county Sheriff Depts. are refusing to detain persons on immigration holds alone. Lee and Orange counties, mentioned as locations in the indictment, are approaching the immigration issue differently with Lee county in the refuse group and Orange county not in the refuse group. This may be yet another reason to push for federal charges, to make sure JG cannot bond out on state CP charges, and then could be released due to only an ICE hold remaining. Diana, who is Hispanic, is 4'4", 95 pounds, with dark hair and brown eyes. She has two scars on one of her legs. She was last seen wearing an unknown color shirt, blue bottoms, unknown shoes, and may be carrying a green blanket with flower print.

You're welcome. Btw, the counties that don't honor ICE requests do honor warrants, they aren't sanctuaries. The FL Sheriff's Assoc has more info here about the hold requests and the problems they cause. There are other problems with existing laws.

Being held on an ICE detainer is physical custody only, like the protection of witnesses, not legal custody. Legal, not physical, custody in a federal prison is one of the necessary criteria for civil commitment of dangerous sexual offenders under the Adam Walsh Act. These are violent sexual offenders and/or child molesters who have little or no self control. The second and third paragraphs of US v Hernandez Arenado underscore what the justice system is up against when the country of origin says a violent sexual offender is not their problem. On another note, I'm not thrilled with a few federal judges right now. Last week an elementary school principal charged with CP was granted bond by a federal judge in Orlando, despite the judge acknowledging, "The danger he presents to the community is considerable." Federal sentencing for CP can vary widely.

While both Fort Myers and Orlando are in the Middle District of Florida, they're different divisions. JGT won't be going before the Orlando judge. I hope now that he's facing a max of 50 years rather than 20 he'll start to cooperate.

With DA, the alligator situation, Christina Grimmie, and Pulse I'm surprised LE in Florida are not simply collapsing to the floor in utter exhaustion, they have been so horribly overworked. There have been many criticisms lately of the Pulse hostage crisis so I guess I put your words with the meanness of the Pulse thing together and made a little ball of defensiveness. I'm not sure if they can tell who the child is in the pics, otherwise wouldn't he be charged with child sexual abuse?

So I'm not sure if this has been brought up or not, but is it possible that the blanket that is missing is in any of the photos? Maybe that was the reason he asked DA was asked to bring it with her. He was trying to get rid of all the evidence?
I can't believe this precious child has not been found. My heart is just breaking for DA.

Florida has the Jimmy Ryce Act. After serving their sentence, sexual predators can be confined indefinitely in a civil commitment center. Basically, it's a prison, but inmates are called residents. I was a nurse at the one in Arcadia for a short period of time. So, there is hope that not all go back to the streets after prison terms.

Arraignment set for Guerrero-Torres in possession case

Jorge Guerrero-Torres, a suspect in the disappearance of 9-year-old Diana Alvarez, has been inducted by a federal grand jury in Fort Myers on child exploitation charges.
A hearing for Guerrero-Torres had been set June 20 on possession charges.


However, since he was indicted, Guerrero-Torres' federal public defender, Attorney Martin DerOvanesian, said there will instead be an arraignment In Federal Court.

I just returned from a motorcycle trip with my husband and 10 other bikes. We rode from South Georgia to Key West, Florida. The first night of our trip we stayed in Okeechobee (last Thursday) Before we arrived I told everyone I bet we will see searches all over and flyers marking all the stores, light poles, etc. and maybe some national media. Nothing...crickets. It made be so sad. On Friday as we rode the 441 from Okeechobee to Yeehaw Junction, I thought for sure we would see some searches or activity of some kind. Again, nothing. Really broke my heart that there was not some activity going on looking for this child. I questioned, why? However, I am afraid I know. <modsnip>
