It's too bad PS didn't make some kind of serious threat to JS maybe take the kids away and leave her or maybe throw her out in the streets if she didn't sign the consent/ medical release of information form.

When she got in her DUI accident PS wouldn't let her drive, made her stay in a hotel and when she got out he took her straight to rehab.

I imagine that PS knew he was walking on thin ice with trying to keep the peace in that household between the kids wanting him to essentially rescue them and trying to get JS the help she needed without her thinking what he was suggesting was a threat.

IMO what happened to the kids was a result of JS thinking/realizing that her marriage was over. I believe it could have ended even worse than it did if he had threatened her with throwing her out. As is he was willing to provide alimony and the household (if memory serves). I think JS may have waited for the chance to kill Parker and then kill her kids and if the mother in law was there she might have been killed as well.

I do not want to turn this into a gun rights debate, however, out of the millions of handguns, shotguns, long guns legally sold, how many are ever used in violent crime, very, very, very few.

She bought a handgun, because she was a law abiding, sane acting person and followed the laws in that state. She lied and hid what her true intentions of it were, that is her fault, not the law abiding public that owns fire arms fault, please put the blame where it belongs.

Can the judge accept an insanity plea deal without going to trial or does an insanity defense always go to trial? So many cases are plead out here in CA

My issue is she was mentally unstable and should not have been allowed to purchase a gun.
Someone suggested that information from doctors be allowed to be linked to the background checks, to me that sounds like a really good idea.
Just because she was law abiding and "sane acting" does not make it OK.
Not arguing with you about gun rights, just saying there needs to be a screening process that is more equipped to vet people like JS.

ETA- I think I did put the blame where it belongs.....on screening/background checks.

It is my very firm opinion that none of her "illnesses" meet the definition of Insanity. If this were true; everyone with Bi Polar and Maj Depr/Mania would be insane. Anyone with TD would be insane. Anyone with Psychotic features, insane. And this is just so far from the truth that her defense and her def team sicken me. They do; and I can't help but be honest and write it. TD is a NEUROLOGICAL CONDITION in the brain. IT HAS NOTHING to do with Mental Illness; or Insanity. Not in any way. Her defense teams opening statements sickened me. Her behaviour in the courtroom sickens me, and her Male Def Atty has now positioned himself at her side; so that we and the cameraman cannot see her actions as well. What Games. Suffice it to say following this trial is proving difficult for me.

She lied on her application to purchase that gun. That also shows she d amn well knew; right from wrong. As well as all the red lights and green lights she went through to go up and get the gun; go back home; go back again; go back home, this was PLANNED. A Planned execution and she deserves the DP imo; and I'm saddened they took it off the table but I understand....they have a better chance at a conviction of first degree with life off the table. IMO.

I've seen two "waiting period" dates for the gun JS purchased. Anyone know if it was 3 or 5. I've seen both of those mentioned. TIA

I don't think Julie Schenecker was insane at the time of the killings. Last I read Andrea Yates was still in the mental institution. Unlike some other killer of their kids one of whom was amazingly 'cured' within a short period of time and now works in a Walmart (last I heard).

I don't want to see JS beat the system and get away with what she KNOWS she did.

Another jaw clencher like mua? Cherry I think the truth and therefore justice will prevail . Murder in the first no possibility of parole.

Abigial, I'm not sure I understand what a pathological murderer has to do with the difference between mental illness and insanity?

A comment was made that an insane person could not feel remorse. I disagree -- esp. in cases of temporary insanity, I believe that a person who killed in a moment of insanity could feel remorse when they come to their senses. (compared to a pathological killer who would be incapable of remorse)

However, Schenecker's violence was not the impulsive act of temporary insanity, but something she planned for several days (at least). How long can temporary insanity last? And can one be as functional as she was in the days prior to the murder and still be insane?

Schenecker suffered from depression, bipolar disease, and schizoaffective disorder, and she abused alcohol. Her children and husband were openly disdainful of her (that's clear from her husband's emails to her). There was a lot of anger and hurt feelings in that home. I think Schenecker was angry at herself for her failures as a mother and wife, and angry with her family for their disdain. All this anger, coupled with alcohol abuse and mental illness, led to the murders. I believe she probably understood right from wrong at the time she pulled the trigger, but I also believe she felt remorse for killing her children.
