When JS pulled out her gun she said her son, Beau, threatened to hit her. When JS killed her son she said Beau put up a pretty good fight.

IMO this shows JS was cognizant of reality and knew what she was doing. IMO she crept up behind her daughter, Calyx, to stop a recurrence of the resistance she got while killing her son. Isn't being cognizant a sign of sanity?

Beau was also killed outside of the house so Calyx didn't here the gunshot---she was worried one of them would hear it and "thwart" the plan...

Exactly and didn't JS say that she choose to kill Beau first because she thought he might do something if he heard his sister being shot?

Alcohol abuse did not contribute significantly to these murders.

It's part of her she was. Was it affecting her on the night of the murders -- all we can know is that she told us that she was not using alcohol until after the children were shot.

When JS told you she woke with a clear thought, "I'm going to kill myself today." Yes. And she had this thought many times in the past. Dr. O: I had no reason to doubt it.

Dr. O: she talked about the negative effects of a parent committing suicide on the children, including her own.

She went to a pawn shot on Fowler, close to where she lives -- Dr. O: that's what she told me. They directed her to a place she'd never heard of. She said she got there by putting the address in her GPS.

She found out she had to wait several days. Dr. O: that's correct. She had no preference for the particular weapon, that's what she said.

Dr. O: she said as she exited the house with Beau, she thought she had to wash his soccer uniform.

She was still thinking about doing the laundry for the children? Dr. O: yes

She felt her role in life as a mother was to protect the children? Dr. O: yes, oh yes

Even after shooting Calyx, she said she tried to manipulate her mouth so it would like a smile. She put her in bed and kissed her and hugged her? Dr. O: yes

And she covered Beau with a blanket and kissed him and hugged him? Dr. O: yes

And on the morning she got up and decided to buy a weapon, she should have been hospitalized. Dr. O: definitely, without a doubt

Any measure of Mrs. S's state of mind at the time of the event would have to include an acceptance of the fact that she was a severely mentally ill woman? Dr. O: yes

Her initial plan was to kill herself. Then she decided to take the children with her but she never did seriously try to kill herself even though she had plans to kill herself though a number of options. The one choice she chose was the least likely to have killed her. jmo


Didn't she basically pass out before she could kill herself? I'm still unclear about this

Defense is really trying to split hairs...I think that the jury would be intelligent enough to see through this ruse....

I can't say that it was impossible that she didn't know what she was doing at the time of the murders

I certainly hope that the prosecutor begins his re-direct with some sort of question that begins with, "Considering all the possibilities presented by the defense,..."

Just in case the jury doesn't get it.

I think the defense is doing a good job with this witness. I also think the witness is being fairly honest despite being a hired gun

preponderance of evidence (i.e. journals, interviews) Dr Otto 's opinion she did know that she was killing her children and she did know it was wrong...''she had shot her children is what she told the jail staff''.....she still retained the ability to know right from wrong ((objection from Defence of course))..she had a plan ((that she didn't want thwarted by not revealing to others)) and acknowledgment it was worse thing she'd ever done

What is your degree of certainty?

I am convinced, but I can't rule out certain possibilities.

Based on what she said at the scene, in the police interrogation, what she said to her defense attorney and Dr. Solomon...despite the fact that she was mentally ill, she did know she was killing her children, and she did know that it was wrong.

When you concede that certain things are possible, that doesn't mean you doubt your opinion?

Only that I can't be 100% certain, but am reasonably certain of my opinion.

You believe she should have been hospitalized on the day she woke up and decided to kill herself -- you believed she should have been Baker Acted.

Well, she could have admitted herself.

Why do you feel, even though you believe she should have been hospitalized, that she ...
