Even though she should have been hospitalized, she knew the difference between right and wrong, because she tried to hide what she was going to do.

#JulieSchenecker manipulated Calyx's mouth to make her appear like she was smiling after killing her def says

I don't know that I believe that. IMO it may be an attempt by JS to make herself feel better for what she had done. That and placing the blankets on them. IMO JS is not keen on messes, didn't want to leave one for her husband to find and certainly shooting your children in the mouths would be very messy.

Forensic psychologist. Medical degree from USF, residency in psychiatry at U of Fl. Fellowship at U of Fl -- sub-fellowship in forensic psychiatry. Since 1989 in private practice in Tampa - from 1989 to 2008 combined office based practice treating outpatients with mental illness; also did hospital consultations and had admitting privileges. Gave up inpatient part of practice and then clinical practice. Now concentrates on forensic psychiatry (to do w/ law). Has performed 4000 to 5000 evals of defendants in the criminal court system.

Just did a quick search for FL law - seems the defense has the burden of proving insanity by clear and convincing evidence

  • #432

Here's the model jury instruction for "clear and convincing" evidence:

1.4 BURDEN OF PROOF—CLEAR AND CONVINCING EVIDENCE

When a party has the burden of proving any claim or defense by clear and convincing evidence, it means you must be persuaded by the evidence that the claim or defense is highly probable. This is a higher standard of proof than proof by a preponderance of the evidence.

You should base your decision on all of the evidence, regardless of which party presented it.

I take the word 'messy' to mean that she may have entertained a fleeting idea to leave a beautiful corpse to hurt her husband therefore no bullets for her, overdose on pills instead. But she didn't want to leave her husband with the pictures of beautiful corpses of his two children. She made sure they were mutilated and disfigured by shooting them in the mouths with hollow point shells. IMO it show the shallowness of JS's love for her kids.

I didn't think she had any more oxys left....

The primary data he considered began with medical records beginning in 1993 when she was a military dependent. Records from NIMH. Records from USF. Records from Windmoor hospital. Reviewed police reports, medical examiner reports, depositions of lay witnesses, police officers, 3 mental health experts (Croft, Maher, Solomon), JS's journal entries starting 5 days before and ending shortly after incident, emails of JS and her husband. He reviewed her medical and mental health treatment at Hillsborough County jail. He reviewed her records of treatment at Tampa General Hospital where she was admitted for 2 days after being arrested.

Test results at Tampa Gen showed a toxic level of Lithium and prolonged bleeding times which suggested an overdose of Coumadin. Urine drug screen positive for oppoids (oxycodone) and benzodiapines (her Clonopin which was prescribed for her)
