Yeah, I understood JS tried to get the oxy refilled but Dr Oberon refused. The stuff Jane Valez Mitchell calls 'hillbilly heroin'.

He listened to the audio tape of the police interview, and also read the transcript. He watched the video taped interview w/ Dr. Solomon 2 days after arrest. He interviewed JS.

He wrote a 108 page report of his review of the records and interview w/ defendant.

Legal standard in Fla for insanity: the ind. suffers from mental disease which either prevents them from knowing what they are doing, or the consequences of what they're doing, or that they don't know what they're doing is wrong.

His opinion is within a reasonable degree of medical certainty

His opinion in general: She was legally sane at the time of the offenses

The threshhold question to be determine: first, was she suffering from mental disease. She met criteria for bipolar disorder and was experiences a major depressive episode.

Opinion: she knew what she was doing, and she knew the consequences of what she was doing.

What information supports this opinion?

It can be difficult to look back after 2 or 3 years to determine what someone's mental state was at that point in time. You have to review what that person tells you, as well as look at collateral information regarding her thoughts and feelings at the time, specifically the journal entries, which started about 5 days before. Gave great weight to the journal entries. Consistent with statements she made to police officers, to jail medical staff on Friday evening, and her interview with Dr Solomon. Statements she made during that time were consistent with each other and with medical evidence.

Specifically, several statements.
In journal, indicated beforehand that her intent was to kill the children. (I have to take them with me, God will take Beau to Heaven, Saturday massacre, Calyx gets it first, etc.)

Afterward, she was aware she had killed the children.
"I've offed Beau on way to practice"
"Beau and I are going to Heaven. Wish Heaven for Calyx too"
"Kids are dead. In the van, Beau and Calyx in bed"
"I'll see you again in Heaven"
"Beau went first, Calyx went 2nd, I'd sure as Hell wish to go third"

Confusion as to whether the children were alive or dead. "I don't know..l hope they're dead"

Dr. T's opinion that she she was planning to kill the children, and she knew that they were dead afterward.

This is one case where I can equally see the merits of both the defense and state cases. I don't think that's ever happened before lol

My opinion goes back and forth with each witness and even when a witness goes from direct exam to cross exam

No evidence that JS went doctor shopping to load up on oxy only that she told Dr O that she was out of script and wanted more.

IMO JS never meant to kill herself.

She knew what she was doing was wrong.

3 different types of knowledge of wrongfulness:
1) Did she feel she was wrong
2) Did she understand others in society would think she was wrong
3) Did she know she'd broken the law

Regarding point 1:
In journal, she wrote, "the evil starts Thursday"
In interview by police, "this is the worst thing I've ever done in my life"
She stated she hoped to join the kids in heaven "if I get to go to Heaven"
