GUILTY FL - Charles Kinsey, autistic caregiver, North Miami, July 2016 -guilty of misdemeanor

 • #121
I feel bad for the Hispanic officer that thought he had to save a life...and was wrong. I bet he wishes he was perfect like the many that are judging him. I have made plenty of mistakes in my life, I'm glad I'm not perfect. It would be too hard to sit in judgment on people every day. It would be too tiring.

Of course I feel terrible for Mr. Kinsey too. He seems like a really nice man. Like I said in an earlier post, I hope he gets lots and lots of money for his ordeal.

As a side note, why were they sitting in the middle of the road anyway? Mr. Kinsey is an autistic man's caregiver and I don't find it too safe to be in the middle of the road with someone I'm caring for.

If I had to guess, based on working in the field for 25 years, I would say mr. Kinsey was sitting in the road because his patient was sitting in the road. He was clearly (imo) trying to get his patient in a space where he could listen and be safe and until that happened, he was sitting close enough to keep him safe.

Autism is complicated. IMO he was handling the best and correct way. You often just cant give a direction and a get a response that you would from someone that is autistic - thats just how the illiness goes. He sat down with him, was checking out degree of agitation, how confused he was, probably talking very low and slow.

The last thing he needed was a bunch of cop cars speeding up , police radios on, strangers running all over the place.

More about the illiness

....... ordinary sights, sounds, smells, tastes, and touches that you may not even notice can be downright painful ...... may appear withdrawn or belligerent

hearing may be hyperacute. .................. brain can’t filter all the input ....in overload!

sense of smell may be highly sensitive. .........

.... fluorescent light is not only too bright, it flickers. The space seems to be moving; the pulsating light bounces off everything and distorts... too many items . to be able to focus

It isn’t that....don’t listen to instructions. It’s that ............ can’t understand .....

Thought is very concrete:

I.E :

Examples of cognitive processing:

confusing : “Hold your horses, cowboy!” when what one ....means is, “Stop running.” Don’t say ...........something is “a piece of cake” when there’s no dessert in sight ..............

When one says, “It’s pouring cats and dogs,” ... might see pets coming out of a pitcher. say “It’s raining hard.”

Idioms, puns, nuances, inferences, metaphors, allusions, and sarcasm are lost......

...............may be hungry, frustrated, frightened, or confused ........be alert for body language, withdrawal, agitation or other signs that tell you something is wrong. .

Visual supports help....relieve ... stress of having to remember what comes next, make for smooth transition between activities, ...............

......need to see something to learn it, because spoken words are like steam............ they evaporate ........

It may look like .... don’t want to play with the other kids on the playground, but it may be that....
simply do not know how

.... do best in structured play activities that have a clear beginning and end...........

don’t know how to read facial expressions, body language, or the emotions of others.

Meltdowns and blow-ups .... occur because ....senses have gone into overload.............

...may not be good at eye contact or conversation,

I really want to know who made that 911 call and why they said he was suicidal.

 • #124
One thing I don't understand is how they could watch the man with autism for the length of the video and not understand that something was going on with him. Had I known nothing about this story before watching this video, I could have correctly diagnosed him as someone with probable autism. And I'm not a genius, so I don't understand how the officer missed it.

Sickening! As I mentioned on another thread, LE has gotten too gun happy the last few years and too many innocent people are shot. As a normal practice, the police shoot to kill. Mr. Kinsey is one lucky man to still be alive!! Thank heavens this officer was a bad shooter.

For the city to already be talking of a settlement, this tells us this city knows their officer was clearly in the wrong. The city leaders realize there is no way to try to cover this one up, so pay up and get it out of the media!

While everyone makes a mistake, some occupations do not have that privilege built into their job. Think of surgeons, they can't cut you open and play around not knowing what they are doing. An electrician must know how to do wiring, grounding it as needed, or he will fry himself. LE fall into this category. Every call they answer is a different personality to deal with. Raising your gun as a threat and then shooting it, is not the answer! Never has been and never will be!!

IMO, there really are two sides to these latest incidents. The racial side has been building for years and Ferguson was an eye-opener as to what attention riots bring to a situation, as well as the type of backup police departments can bring in. I believe this only further angered people who think like the shooters we have seen.

The second issue is the way police in all sectors are too freely using their guns to shoot people. Years ago, didn't police shoot to stop a person instead of the current day belief of shoot to kill before they kill you?

My opinions only.

“A North Miami police officer was trying to protect an unarmed mental health therapist when he “accidentially” fired a shot and wounded the man, the head of the local police union said Thursday.”

*

“The officer “thought Kinsey’s life was in danger,” John Rivera, head of the Miami-Dade Police Benevolent Association, said at a news conference.”

*

““This isn’t a mistake in the sense that the officer shot the wrong guy, or that Mr. Kinsey was the bad guy,” Rivera said. “It was a mistake in the sense that he thought Mr. Kinsey was a victim and was about to lose his life. And so he attempted to stop the white male and accidentally shot Mr. Kinsey.”

Rivera said the officer wasn’t aiming for Kinsey when he fired.

He couldn’t explain why, after the shooting, officers rolled the bleeding Kinsey to his side and handcuffed him.”

They need to stop talking. This makes no sense whatsoever.

Isn't it incredible that he went to shoot the autistic patient playing with the toy truck and actually shot the carer on the ground with his hands up!!

3 shots missed the target and got the wrong guy! It's a good thing the carer wasn't killed!

Also, you know this wouldn't have happened (and probably not have even been called in) if the carer and patient were white.

Lol .. Since when is shooting the presumed potential victim not a mistake??? Yes, stop talking, pay the money, sack the policeman and charge him, then offer him a great plea so he shuts up too.

Then RETRAIN your police to be way less trigger happy and only shoot when necessary and when lives are actually threatened.

What a joke. If I was a black man in America I'd be making like a hermit and staying inside until things are better, or moving to Canada.

Meaning to shoot the young man and shooting Kinsey instead is no better than meaning to shoot and shooting Kinsey! Admit what you did and stop with the ridiculous excuses.

The Most Disturbing Part About The Charles Kinsey Police Shooting

An innocent man got shot, and the police officer couldn't tell him why.

LE still asking for people to come forward with any information.

https://www.google.com/amp/m.huffpost.com/us/entry/us_57911026e4b0bdddc4d39718/amp?client=safari#

If that's what a LE does, he needs to be in jail.
No way I could let that happen to a caretaker, a responsible person whom you trust with an autistic person that needs constant attention. Heartbreaking! I hope we get the truth/full story and who felt justified to call 911

 Some people just never cease to amaze me. So sad

do you think they took it to punish him?

it is evidence, they have to take it.

if this officer were ever going to be charged in this shooting it would be required at trial.

So lets get this straight. The cop thought the therapist’s life was endanger from an autistic man playing with a toy truck. Despite the therapist clearly telling the cops that there was no reason for having their guns out, the cop tried to shoot the autistic man anyway, but hit the therapist instead. So then he handcuffed the victim, and let him bleed out for 20 minutes before getting him medical attention.

When asked by the victim, why he shot him, his answer was, he didn’t know. But now he comes up with this cockamamy story. Anyone else giving such a BS explanation for shooting somebody would be put immediately in handcuffs and taken to jail and held on at least a million dollar bond. But because this guy is a cop, he is a free man right now on an all expense paid vacation at tax payer expense. This country is absolutely ridicules.

Hi drjones

Not sure what you are referring too as punishment, I apologize.

Yes of course I agree it should be taken to trial but I can't say what the LE and others will decide how it will be handled. I have not yet heard from the LE other than the News Conference.

I was just expressing my thoughts and feelings from the news article and how it affected me. Thankfully no one died from this incident.

Again all JMO

From the Local10 article previously posted:

http://www.local10.com/news/exculsi...uns-drawn-moments-before-north-miami-shooting

“The owner of the group home, Clinton Bower, told Local 10 News that the autistic man, who is nonverbal, was handcuffed and detained by police for hours.

He said his client had to be hospitalized after returning from police custody and said officers confiscated his toy truck as evidence.

Bower called Kinsey a hero and said he did everything right in following police's orders and making sure his client was OK.

Bower said he offered North Miami police training on how to deal with people with disabilities two years ago after police stunned another client with a Taser. He said the department never took him up on his offer.”

So much for Community Policing.

And, something I have wondered about. In the same article it says: “However, the man who took the cellphone video claims the officer was looking through a scope when he fired his weapon.” Which, if true implies to me that he should have been able to see that the object was not a gun.

Hi I.b.nora

Heck even I could see there was no gun on the autistic person and I'm half blind(not really). But if the officer used a scope???? And hearing Mr Kinsey words??? Not looking good.

there is no scope on any weapon that can be seen in either video as far as i can tell, i do not think the person who fired his weapon had a scope

Just another racist cop trying to use his powers to kill a black man. Then when he is facing attempted murder charges, he starts brainstorming with his union and comes up with this cockamamy story that he was just trying to protect the therapist from the autistic man playing with a toy truck.

With the sad state of our justice system, this BS might just work for the cop. I think if it goes to trial he will be convicted. So the union will try to make sure he is not even charged.
