he chose to act according to his impulses, no one forced him to kidnap, rape and murdered this little one. if rayne didn't make it so easy for him by putting cherish in harm's way he might have been trolling parks and neighborhoods...it was more a question of time, not a question of if.

are there any documented cases of sex offenders that have been successfully rehabilitated?

This makes me think that there just may be some mental deficiency or disconnect, at the very least. Does he not see the irony in what he said? How can a grown man knowingly subject a small, defenseless, innocent little girl to the VERY thing he himself fears the most??

There is a line in the autopsy report that makes me wish I had never heard of this case. It's very short and very clinical, but made me feel a rage I've never felt before, and I haven't been able to scrub it from my brain since I read it. He deserves no mercy.

From a new article ....

Soon after police arrived at the Walmart, Perrywinkle told police she didn’t want Cherish to go to California to see her father, as she was scheduled to do the next day. This led police to suspect Perrywinkle may have staged the abduction to keep her daughter from her dad.

Officers at the scene noticed a lack of tears when Perrywinkle was crying, found it odd that she and her boyfriend started arguing over purchases she made at the Dollar General and were surprised to hear her repeatedly say she believed Cherish had probably been raped and murdered in a matter of fact voice that displayed no emotion

one can only hope. there is no rehabilitating this monster. Period. Hoping his prison mates do us all a favor. I know that is not PC but it is how I feel. I do not apologize. He can never be allowed in society again and he will simply be a drain on society in jail.

I have a very 'eye for an eye' attitude when it comes to child raping murderers. I feel no guilt whatsoever wishing his prison buddies could deliver the justice in the same way he delivered his criminal acts on Cherish, including the same exact level of fear and pain, and for the same exact duration that he imposed on this sweet, innocent child.

I also believe criminally negligent mothers (who hand their children off to strange men they just met and admit they find creepy, to escort their little girl to the fitting room several times, and to escort, alone, away from mom's eyesight, her little girl.... on a date for burgers), whose children end up raped and murdered, at or around the time of that parent's neglect, should be charged with, and do time for, criminal child negligence.

Oh, and DS's mother. She admitted to buying drugs for DS. (paying his past due bill) Can we get some investigating, in the very least, into welfare fraud on behalf of herself and DS? Why were tax payers providing him food stamps, when he appeared to be living with his mommy, getting three squares a day, driving his mommy owned creeper van whenever and wherever he liked (no car payment), with money enough (his and his mom's) for his crack habit?

Poor Cherish. The most innocent of victims, who had the misfortune of stepping in the absolute center of this sick Bermuda triangle of morally repugnant people: A child molester, a grifter, and an enabler.

Just read the reports (discovery). I guess I missed the autopsy report cause I thought the police report was all or RP rambling that evening.

On last page of the report (discovery) was the book that the news is talking about now. They are talking as if this just happened recently. He (DS) actually received it in Sept.

We did know previously (from that initial discovery info dump) the fact that he requested and received a copy of the DSM-4.

What's newly released info to us is that they have the recorded conversation in jail between DS and his mom where he makes the request.

But Smith's most surprising statement was made during a jail visit with his mother. Officers who listened to a recording of the two talking say Smith wanted his mother to get him a DSM-4 book -- a book that highlights psychiatric problems. Smith said he could use that to find out what level he needs to qualify for treatment.

"It's a one shot deal. I need to know what I have," Smith told his mom.

So we knew he must have requested it, we didn't know exactly how (written request through lawyer?) Now we know exactly how he asked...he asked his always so helpful momma.

To quote our fellow websleuther ontheclock....DS is a malingering fool.

I am in shock that there hasn't been at least one more arrest in this case, I do not for one second believe that Cherish was kidnapped. I think that DS leaving without giving Rayne the gift card is the only thing that prompted the 911 call.

The fact that Smith is a registered sex offender will probably not be revealed to jurors during the criminal phase of the trial. But if he’s convicted, the jury might find out about it during the penalty portion.
Lawyers for Smith also are asking Cooper to exclude gruesome or inflammatory photographs from the jurors during trial, prohibit the prosecution from automatically excluding jurors who express reservations about the death penalty and have one jury vote on his guilt or innocence and then bring a second jury in if he’s convicted to recommend whether he gets death or life in prison.

"We filed a notice seeking the death penalty. In doing so we asked for any mental mitigation which the defense intends to introduce," Caliel said.

In this discovery, Smith in a jailhouse conversation, told his mother he couldn't go to prison because he knew he would be raped and murdered there.

He talked about how if he was on Death Row his death would be simple, happy and peaceful.

His attorney was doing everything to keep him off of Death Row if convicted. Gazelahhe also asked the court to exclude the pictures calling them gruesome and inflammatory.
Former prosecutor and now defense attorney Richard Kuritz said the tactic is pretty common in death penalty cases.
The judge is expected to rule on the motions later on.
Caliel made a strong objection against excluding the pictures of the autopsy and the condition of Perrywinkle, but said he would be willing to have the courts review them before hand to make sure they are relevant to the trial.
The next pre-trial hearing is scheduled for February 12 and the trial is set for May.

"The bill fixes loopholes where inmates were inadvertently released from custody. And under this bill, these individuals will be detained and evaluated for civil commitment." The legislation also requires at least two experts in sexual predators to agree that someone is not a danger to society before they can be released, even if their sentence has expired.

On Thursday during monthly a JSO awards ceremony, Rutherford gave certificates of appreciation to three people including Brenda Fillingim, who provided information to investigators during the early stages of the investigation.
What police were looking for was a white van that they believe was involved in the alleged abduction.
"I saw the van. I went back to my home and found out what was going on then I went back and it (van) was gone," she said.
Reporter: You went to the substation and told the police?
"Two detectives followed me back down there," said Fillingim, who had been out that Saturday morning going to garage sales.
Her information helped lead police to where Perrywinkle's body was eventually found in the woods near the Highlands Baptist Church.
Two other people who helped with information, Jerome Bruton and Christina Howard, could not be present to accept their appreciation certificates.
Rutherford said people who get involved make a big difference in fighting crime. The sheriff told the audience for the awards ceremony that crime in Jacksonville is the lowest in 40 years.

I check back often hoping to read that Rayne has been charged for her role in Cherish's death. I just can't fathom any mother handing their child over to an unknown, creepy (her word) man. Our greatest responsibility as a parent is protecting our kids, at all costs - Rayne had a price though and she valued a WM gift card and a fast food burger over her beautiful child.

If she manages to escape the punishment she deserves I hope she is never allowed near another child. She has already proven herself far to willing to put a price tag on their head.

It always jolts me when I see this case bumped. I remember when it was all just happening, the reports of the suspicious car and subsequent aftermath, RP was quoted as saying in her description of Cherish, "She was always such a little lady." The accompanying photo showed Cherish in a bicycle helmet, which indicated.. basic precautions. But something struck me so wicked about her quote even before the ghastly details came out. What does "lady" mean, and why was Cherish a miniature version of that? To me, it means: Feminine. Demure. I had visions of child-pageant style lipstick being put on a 1st grader who had never heard of it until then, by a mother whose circumstances tragically lead her to accept that sexual appeal was the be all end all. It's seeing your 8 year-old in a two-piece and joking about her "driving the boys wild one day." Maybe it's psychically, yet in jest, referencing her teenage years, in which her protector is "beating them off with a stick." It's a meek persona arising from the strangers she meets and has to hug, despite potentially being uncomfortable with it, because anything else would be rude, and she must learn from a young age that her body is not so much hers as it is others'. It's telling her to get over her scraped knee that a boy in her class gave her at recess, because "boys will be boys," and she's being a good girl by not fighting back.

Perhaps I'm biased against RP, and that statement meant nothing. But it still disturbs me when I think of it. She was in "must-sound-like-mourning-mother" mode, and her attempts at that fell disgustingly short. JMO all around. I've never commented in this thread, so pardon the intrusive soapbox.

Thanks wasn't enough! I think you beautifully summed up everything that was off about RP from day one. What has always struck me about her is the complete disconnect between the words coming out of her mouth and the context. She knows the 'victim language' but her context is so off. Cherish never stood a chance and it should not have taken her death to prevent her sisters from becoming victims too.
