"...It is likely that defense attorneys Julie Schlax and Charles Fletcher will end up arguing that Smith is insane or too mentally handicapped to face the death penalty. But the lawyers have not yet indicated what their defense will be.

Smith is charged with first-degree murder, kidnapping and sexual battery. He is a registered sex offender who was released from prison three weeks before Cherish was killed.

He is accused of befriending Cherish, her mother, Rayne Perrywinkle, and siblings at a Dollar General store in June 2013 and convincing them to go to Wal-Mart on Lem Turner Road in his van after offering to buy them clothes and food.

Perrywinkle told police that Smith offered to buy the family hamburgers at the McDonald’s inside the Wal-Mart.

Cherish went with him to get the food, and they did not return.

Cherish’s body was found near a creek off Broward Road the next morning."

I wonder how much will come out during the trial and if further arrests will be made at that time.

I was just thinking of Cherish the other day. I still wonder what part mother had in this. Did she arrange to "rent" cherish to DS? I can't think of many mothers who would just let their child wander off with a stranger.

She didn't just let her wander, she actually PLACED AN ORDER for Cherish to fill since she was going to McDonald's with DS!! I can't remember which number version of her story that one was, but it was after her recitation to reporters of always reminding Cherish to never talk to strangers but before her version evolved into Cherish just slipping away with DS while Rayne's back was turned and she just happened to not notice until more than 20 minutes had passed.

At a Thursday hearing Assistant Public Defender Fred Gazaleh argued he wanted jurors to know that Perrywinkle has said she’s clairvoyant and always thought her daughter would be dead by the time she was 8.

I don't know about clairvoyant but knowing she'd die by the time she was 8 and clearly not having any plans to get Cherish to the airport the next morning. I'm not buying what she's selling. Still super hoping there is an arrest after this trial that includes some hefty charges.

Let's pretend for a minute that Rayne had no part in Cherish's death, didn't give her to D for a WM gift card. Let's go ahead and pretend she is clairvoyant. Is she still not responsible for handing her child over to a RSO? If she knew Cherish would die, why did she let her go? Not that I believe that she's clairvoyant, but I don't have any doubt that she knew the outcome for her choices.

I might not be clairvoyant, but if I hand my 6 year old to a registered sex offender, I can make a solid guess that he will be injured or dead before the night is done! I need to get myself a 1-900 hotline! Call me one of Ms. Theo's friends!

she is clairvoyant and "knew" that cherish would be dead by 8 therefore she willingly allowed her to go with a total stranger? pity her clairvoyance did not include common sense or went any further
if she "knew" what would happen to cherish, wouldn't she also know that D would be responsible for her death?

Secret jail recordings a first in Donald Smith case

Law enforcement has long relied on surreptitious means to obtain confessions -- be it recorded phone calls or jailhouse snitches.

But secret recordings of a type not seen before in Duval County have surfaced in the high-profile criminal case of Donald Smith.

Accused of kidnapping, raping and killing 8-year-old Cherish Perrywinkle in June 2013, Smith has been held in solitary confinement pretty much since his arrest. But unbeknownst to him -- and his attorneys -- secret recordings were made while he was in his jail cell.

Janet Johnson is a criminal defense attorney who has represented hundreds of inmates at the Duval County Jail, and is well familiar with the ways law enforcement tries to extract information from her clients.

“There are all kinds of ways to get people to confess, and some are a little sneakier than others,” she said.

But Johnson was not aware that there was surreptitious recordings of inmates in their cells -- because it’s new. On Feb. 2, the state revealed it had secret recordings of Smith talking to another inmate, Randall Deviney, who was sentenced to death last year for killing his neighbor.

Smith is set to go to trial in April 4, though that will likely be delayed. He faces the death penalty if convicted.

Donald Smith still faces possibility of death penalty

The man accused of killing 8-year-old Cherish Perrywinkle in June 2013 was back in court Tuesday morning as his attorneys argued that the death penalty should be taken off the table.

Florida lawmakers are working to revamp the state's death penalty law following last month's Supreme Court decision that ruled sections of the law unconstitutional.

The defense argued Tuesday that under that ruling, the court does not currently have the authority to impose death. Smith's attorneys requested a maximum penalty of life in prison when his trial begins. It is slated for April 4.

In addition to the death penalty motion, Smith's attorneys want the trial moved out of Duval County. Their concern is that come trial time, finding a fair and impartial jury will be difficult.

Smith's next pretrial hearing will be March 8. Final pretrial hearings are set for March 31.

We believe one of the below calls was the tip given to police that helped them find the little girl's body. Another is a call from a man who professes to be Donald Smith's friend, telling police where he thinks the man might be hiding.
