Her body was found in the marsh of Broward Creek, lying on her left side, half under water, covered by a fallen log, rocks, grass and a branch, according to the medical examiner's report.
Cherish was still wearing the orange dress from the surveillance video, but it was pulled up to her chest and she was naked from there down, the report said.
The medical examiner's report found that the sexual trauma Cherish had suffered was brutal. She had bruises on her body and evidence of blunt trauma to her face and head.
Once a jury is picked, the trial is expected to last three to four days, with another three to four days for the penalty phase. It’s uncertain if the penalty phase will start immediately. In Duval County, there’s usually a one- to two-week gap.
Donald Smith jury pool narrows to 80 in high-profile child murder case
Dismissed potential juror says he wishes someone would shank Smith in prison
The 80 potential jurors will return to court at 9:30 a.m. Thursday to begin the third and final interview of more personal questions that will help select the final panel and alternates.
Dozens of those who did not make it to the final pool of 80 people who began a third and final round of the selection process Thursday had said they had already made up their minds about Smith, who is accused of kidnapping 8-year-old Cherish Perrywinkle in June 2013, brutally raping her and dumping her half-naked body in a creek behind a Jacksonville church.
I don't think anyone ,after hearing all the evidence once its presented, could not find him not guilty. What he has done has gone against every moral code of nature when he took that girls life. I think the only people who could turn a blind eye is sadistic people just like his kind. All my own opinions."According to the Florida Department of Law Enforcement, Smith's DNA was found all over Cherish's body, including her neck.
The medical examiner found that bruising on her neck and other evidence indicated Cherish was strangled."

Search high and low, change the venue to Timbuktu, but here's the question: Is it possible to empanel a jury "impartial" enough to turn a blind eye to this overwhelming evidence?
