Law enforcement did not do any toxicology on DS (they had the opportunity but did not). The cocaine use is self-reported, as was the seroquel, which was also obtained illegally to control his ups and downs from cocaine use. There were no drug tests in the records reviewed at all.

You're right. He couldn't have been -- as he was having an "out of body" experience at the time. But, he was able to look down on someone who WAS driving it. He looked a lot like DS.

There is no evidence of DS's cocaine binge (high use, back to back, for the 7 days prior to his crimes) other than DS's word.

Your correct....not a defense at all. But I think the defense attorney is looking for a small crack of empathy so he lives instead of dies. I'm not a proponent of the death penalty because of some work I did on death row in Georgia. But I have difficulty with this case.

This witness did review the Walmart footage, but did not speak to DS's mother, nor the couple DS spoke with in Walmart parking lot. DS said he smoked cocaine in the Walmart bathroom.
