Crime scene and officers on scene did not find any of the newly purchased items that Rayne had left in #DonaldSmith 's van, nor her stroller, despite Smith's van being empty when he was pulled over.

I know the defendant's criminal history would normally not be admissible or even mentioned in court but did I read here that DS had only been out of prison for 20 days? Is that correct? What was he imprisoned for? What about criminal history prior to that?

#DonaldSmith mother said her son was first arrested in 1977 for exposing himself to children, but she thought it was a misunderstanding. He was then arrested for sex-related offenses in the '80s and ‘90s.

"In 2009, Smith was convicted of attempting to take another young girl. On Sunday, Stephanie Thornton told Action News JAX about the incident, in which he tried to kidnap her own daughter.

Smith called the girl’s grandmother, pretending to be a Department of Children and Families employee. He claimed that the 9-year-old had been raped and that he needed to meet her at McDonald’s “to pick her up to take her to be checked,” Thornton told the station.

Suspecting he was a fake, Thornton contacted police and Smith was arrested. In 2012, he pleaded guilty to attempted impersonation of a public employee and attempted child abuse. He was released from jail on May 31, just 21 days before he allegedly kidnapped Perrywinkle."

"On Monday, State Attorney Melissa Nelson described the horrible manner in which 8-year-old Cherish Perrywinkle was killed in 2013. This week kicked off the trial for the Florida man accused of kidnapping, raping and murdering Perrywinkle. Donald James Smith, 61, faces the death penalty if he is found guilty of first-degree murder, kidnapping and sexual battery, reported The Washington Post. He has pleaded not guilty.

Nelson said that the child’s last five hours alive were torturous.

“He gagged her, raped her, he sodomized her, then he strangled her. He gagged her with such force, her gums and nostrils bled. He strangled her with such force her eyeballs bled,” Nelson said. “Cherish did not die quickly, and she did not die easily. In fact, hers was a brutal and tortured death."..."

What I heard her say was that he got snappy with her, and when asked what she meant by that, she said DS asked "do you want to see my driver's license?" Almost in a sarcastic way, causing her to feel foolish for being wary of him. I didn't think he actually showed her his license.

Auntie, I apologize. You were absolutely correct. I was wrong in that DS did not show his driver's license to Rayne.

I was really surprised Smith asked his attorney’s not to cross examine Cherish’s mum I’ve never seen a defendant do that before in a case. I don’t give him any credit for this though and he certainly deserves a possible death sentence for what he has done.

After hearing the prosecution's opening today, the ME's testimony will be tough.

I'm just hearing the opening...wow. Couldn't be any worse. IMHO.

I hate listening to the descriptions of poor Cherish's body. I can't imagine how hard this is for the jury to see.

Yes, that's got to be gut-wrenching -- so is thinking about that little girl when probably horrible things were done to her. The autopsy should show whether she was alive or dead when her little body was put in the water and held down by the (OMG) asphalt pieces and plants. And I'm hoping her body will also show what was done to her before she died, and how she died. The autopsy pics should be alarming and horrible, I'm thinking. All of that plus other testimony will help the jurors come to what they think is a just verdict. They're doing their duty to the People of the State of Florida, to that beautiful 8-yr-old innocent child, her family, LE, and to the accused DS. What a tuff order for them. It's not a perfect system, but it is the best we humans can do. Oh, this is so damm sad.

Officer Wilkie said his own daughter had same orange dress as Cherish was wearing when he found her.
That is so heart wrenching.
