Spelly- That video I posted today was from the guilt phase and not today's verdict- so that's why the judge said Tuesday. Wrong Ytube- my mistake..:(

Here is today's verdict Ytube:

DONALD SMITH PENALTY PHASE VERDICT

ETA: Now I'm gonna go hide under my bed...

Thans for your patience with me, Jax49!

Y/N, that must be why it came up wrong, I had been using the link from your video here. But when I switched over in the middle to youtube, it went to the wrong day and I didn’t even realize. I’m still the dunce of the day. Sigh

Just wanted to mention, too, that the aunt who has adopted the sisters of Cherish has hit a snag that does not allow the girls free access to school here. Education is free here for Aussie citizens.

She is trying to raise funds - through crowd sourcing - to go through the convoluted process of having her adopted children with another nationality become Aussie citizens, so they will be eligible for all the rights of an Australian citizen.

Hopefully something that requires teeth to eat it with.

LOL! That made me laugh. Yes, I hope so! Although, I do not want him to starve to death. He needs to live in misery for as long as possible.

Jury Recommends Death For Donald Smith In Cherish Perrywinkle Killing

"...The jurors, who took only 12 minutes last week to find Smith guilty of kidnapping, raping and killing 8-year-old Cherish Perrywinkle, unanimously agreed to recommend the death penalty in the case, according to our News4Jax partner...."

He will be isolated, have no access to his 🤬🤬🤬🤬🤬 magazine, or the prison drugs, or young girls coming to do a school field trip. 20 years of nothing but 4 walls to stare at is a good enough start for me

And very bad food. Every day, every day, every day.
Well, he earned it. Wallow in it, you low-life.

Nothing could ever bring back what this monster has taken from so many. Nothing could ever repair what he has destroyed. I'm happy that maybe a little bit is still right with our world and our justice system. There is work to do in our justice system in regards to sex offenders, but today it did right in this verdict. Proud of the jury.

Aussie here so late as usual due to time issues.... I am usually the most anti DP person ever but here?? If not this "rock spider" as we call these sort of "men" here in Oz (nothing lower except dirt) then who actually deserves it ?? JUSTICE at last for beautiful little Cherish. Thank you jurors ..

A good article summarizing the sentence phase published here:
http://www.jacksonville.com/news/20180222/jurors-decide-donald-james-smith-must-die
Caliel has handled the case ever since Cherish’s body was found. After the sentencing recommendation was announced, he said he was “happy to get justice for Cherish. ... My daughter was 13 at the time the crime occurred, so it hit close to home.”
“Life in prison was not an appropriate penalty for this crime,” Nelson said. “If not [the death penalty] for this murder, then for what?”
Caliel dismissed the idea that Smith lacked impulse control, reminding the jury he laid a delicate trap for Cherish and waited hours to execute it. He presented six factors, including past convictions, Cherish’s age, the heinousness of the crime and that the crime was carefully calculated by Smith.

I commend the jury on their work on this case; I'm sure their lives are forever changed by the experience.

How Cherish Perrywinkle's killer could still avoid the death penalty

"...Judge Cooper won't hand down a sentence until Smith, 61, receives another opportunity to present evidence in what's called a Spencer hearing. Smith's hearing is set to take place March 28.

“The judge can always review the law as it applies in the case and determine whether or not there was legally sufficient aggravating factors to impose the death penalty," said Assistant State Attorney Mark Caliel, who prosecuted the case alongside State Attorney Melissa Nelson.

Caliel said the state anticipates it too will present information that prosecutors chose not to introduce during the penalty phase of the high-profile trial. Specifically, he said Cherish's mother, Rayne Perrywinkle, will deliver victim impact statements in the case..."

Cherish Perrywinkle's mother says Donald Smith got what he deserved (with clip)

"...Cherish's mother, Rayne Perrywinkle, said that's the only punishment fitting for Smith, whom she called “a demon.” She said she was grateful to the jurors and the prosecutors for giving her little girl justice.

“He has destroyed a lot of lives,” Perrywinkle said. “And now he gets to pay the consequences for what he has done. He made the choice. He alone.”..."

By my count, this was a 2 hour & 10 minute verdict. #DonaldSmith @FCN2go

Yeah, but didn't they have lunch? Maybe 1/2 an hour to eat, or did they work while eating?? We don't know, eh? Personally, I think less than 2 hours....

and :tyou: YESorNO for the updates!

Thank you, Bravo, for being our "voice of reason" and for notifying us when it was time for uncorking (or decompressing in whatever manner one chooses)!

Aww thanks Alexwood. It was a pleasure being here with each and every one of you. This was a tough one. I had my dental appt. Had a brief cry and spent the eve keeping busy. Back today, refreshed. What a great support system here :loveyou:

I thought they said during the trial they aren't allowed to have dentures in prison.

Apparently, they are. The document says that they will not be supplied for cosmetic purposes, but if they need them to eat, they will be provided. One set per lifetime. Unless he has had a set provided by Corrections before?

The following criteria apply to the fabrication of routine acrylic partial dentures

4. In the treating dentist's opinion, there is insufficient number of teeth (including replacements) to masticate a normal diet.
