The problem with this...there is currently no way to diagnose CTE in a living patient. . It's all conjecture. I'm sure the state will do fine with this witness. I think (I hope) the jury will see this as grasping for something, anything.

ETA: Also...no one that has been diagnosed with CTE post-mortem, ever committed rape and murder of a child while they were living, that I know of.

I doubt this Dr. gives a crap whether the monster lives or dies, but he sure does appear to love his job! He's very passionate about this. I'd go to him if I had a brain disease :).

Also, Dr is talking way too fast for court reporter. And me. Judge asks him to take a breath between each slide. He says he's testified before and knows he talks too fast. "I get excited," @FCN2go #DonaldSmith

DS looks like he needs a good rhinoplastologist, rather than a brain doctor. Oh, heck. Nothing a slight adjustment with a sledge hammer couldn't fix.

I wish they would skip to the part that explains why the jury should care whether the defense can prove psychotic pedophelia is the result of brain damage and a horrible upbringing. There is nothing to be gained by letting him live either way.

I don't think his (or any) testimony will sway the jury away from DP.

Guys, I literally can't understand anything. It's the job of the defense to make sure the expert witness is relatable to the jury. This attorney should be asking more questions and not letting the guy just rattle off long responses. He should slow him down, he should clarify. He is not in control of guiding this testimony, at all. He is really failing to do his job here. No way is the jury getting any of this.

Have any of these incidents been proven by medical records or is this self reporting. Heart attack, fall off bike, car accident?
