IMO, I think it depends if anyone in the A family (not in prison at that time) files for custody. If both the Markel gparents and A family members file for custody, there would be a custody hearing where a judge would decide which environment would be best suited for the boys. Age would be a factor against the Markel GPs, but Dan also has a sister who may be interested in custody.
While I agree with the statement on the hearing for the custody of the boys, I cannot imagine a judge considering a member of the A. Family if one or more are in prison for the murder of Dan. After all, as the judge will surely know, the argument on the city where the boys were to live is what got Dan murdered. Grandmother Donna wanted them to live close to her. For me, the Alderman's do not lead a life that is the type Dan or his family live, let alone raise children in.
Take these boys away from all this filth and let them grow up in a new environment while they are still young. They have a rough road ahead of them, but with good therapists and a loving secure home, may they become the young men Dan hoped they would be.
