Can't some journalist in court report please report on jury's demeanor? Does it look like one holdout???

  • #1,185
yes but without her would CA have been able to find someone through his other contacts to kill him? we will never know. JMO
Probably. Honestly. JMO

Did you guys hear the defense attorneys say they may not represent her in the future?

I agree. This is ultimately going to be good news. She's under the "sword of damocles" more than ever and the prosecution can now charge CA and DA.
Gosh I hope!!!

Would they try the A's before her?

And will SG plea bargain a lessor sentence and testify against her?

Just makes me sick!
Don’t fret just yet. It’s not worst case scenario. Disappointing- yes. But she can be tried again! And now that SG has been found guilty - maybe CA and Da will be charged.

To everyone above bemoaning the mistrial on KG, please take a step back and relax. Overall this was very much a win for the prosecution. Guilty on the triggerman, and a mistrial which very much favors the prosecution on the next go-round. KM will stay in custody pending a new trial, and the way this played out it will be much easier for the prosecution to fix any of the shortcomings that led to the hung jury than vice versa. There is even a way of viewing this wherein it is more likely that KM will cooperate to provide information on the alleged masterminds - she is exhausted after this trial, and now faces the daunting prospect of going through another one where she almost certainly knows the likelihood of a conviction is high. The pressure is on her to cooperate, and she can do so in a way that is much "cleaner" for both her and the prosecution - by working out a deal *prior* to a conviction rather than desperately scrambling to save her own hide after one.

If her family was indeed paying for her defense then this will tighten the screws even more. Now she may have to go with a PD. State should be ready to retry this case immediately. There's no need to wait. Next time state needs to bring their A game. Cause if she walks it's a true travesty!

Why haven't we gotten a decent lip reader here at Websleuths yet!? I'm dying to know what her attorneys were saying to her!

IMO, Georgia needs to make this up to us by giving us an Adleson perp-walk today:D:D:D

They are going to at least have to bring CA to trial or they risk KM getting another hung jury. They have to bring charges against that family!

We're just impatient. The wheels of justice grind too dang slow ;).

CourtTV discussing whether KM is so "tainted" to be unusable to the prosecution. Consensus agreement is she WOULD be of value if she testifies against CA in a way that can be corroborated.

Dan Markel murder trial verdict: Sigfredo Garcia guilty, mistrial for Katherine Magbanua
"The 12-person panel found Sigfredo Garcia guilty of first-degree murder at about 2:50 p.m. following two weeks of testimony. After briefly continuing to deliberate on the fate of the mother of his two children, Katherine Magbanua, it became clear they could not reach a decision and a mistrial was declared.

Magbanua burst into tears as the verdict against Garcia was read. As Garcia was taken out of the courtroom he said "I love you, Katie."

Magbanua will remain a charged co-conspirator in the case and the state will try her case again with a hearing set for Oct. 22."
