He stabbed his mother how many times?! 47?!!! Sorry, but I'm not overwhelmed with sadness that he might get a little lonely and bored sitting in his cell. Or even if he gets a little behind with his education.

Respectfully, that is not the issue. School districts cannot "pick and choose" who to give special education services to. That is why PL 92-142 was enacted, because school districts were doing that.

What next? It is a slippery slope, but if Miami-Dade can blow off the law for this child, why not stop teaching Braille to blind children? It is so expensive to buy Braille books. They can just listen to audio. (Believe it or not an actual school board official actually said that). LOL.

The way I understood the article was that they are refusing to "give" him one rather than providing the services of an already existing IEP. Please correct me if I am not understanding that correctly.

The reason I am curious is because of how it could play into his defense and eventual potential sentencing.

I don't think he he had an existing IEP prior to incarceration. When arrested in Oct 2023, DR was first being held in juvenile detention but once he was indicted by the GJ and charged as an adult, he was transferred to the adult jail where he's housed in a separate section with other youth but I believe he's likely the youngest inmate. Reportedly, at the time of his arrest, he was an honor student.

From the MSM link in question, DR is currently enrolled in a combo IE and group classes, and we don't know the source of the defense allegation that the school district is refusing to provide DR an IEP but the Court gave the parties 21 days to resolve the outstanding issues related to DR's education and detention.

To be clear, as we learned during the Dec 2023 evidentiary hearing that just because the defense makes an allegation -- it doesn't mean that it's true! The parties were also ordered to submit proposals for areas where they couldn't reach a consensus in 21 days. I think we will have some answers sooner than later. JMO

NBC6 was told he is the youngest of 34 juveniles being held at the new juvenile section at Metro West, and that the rest are 16 and 17 years old
The murder “left everybody dumbfounded,” Rodriguez said. He called it a “huge tragedy,” that left a Garcia’s mother without a daughter and Rosa’s biological father essentially without a son.

The lieutenant described Rosa as an 8th grader and honor roll student at iMater Charter Middle/High School. Friends and family described him as a “good kid” and a straight A student. The teenager had no history of mental health challenges; neither did his family. There were no fights, and he got along with both his stepfather and half-sister, Rodriguez said.

I really don't know what to think about this case. It definitely needs assessment to determine if there is potential for Rehabilitation. I don't like to think, with a child this young that there is not...on the other hand, there have been several child murderers who were released, and went on to be serial killers as adults.

"We believe in Derek's innocence and we will continue to support him and his family until the very last minute," stated Univisión 23 Dalgys Reina Fonseca, one of the women who supports the young man and his family.

Derek had a hearing last Friday, February 7. During it, the defense of the young man reiterated the request for the images obtained from his mobile phone, which the prosecution maintains as key evidence in the case. The prosecution has indicated that a digital forensic expert has already analyzed this evidence.

From Court records beginning Dec 2023, the defense used labels alleging Autism and ADHD to describe the juvenile defendant, DR, and the basis to remove him from adult jail and send him to juvenile detention.

However, after the defense called DR's instructors as witnesses to make their case about how the defendant's civil rights were being violated by holding DR at the adult Metro West Detention Center, the trial Judge revealed that it had a good 7-8 years of school records which did not indicate DR to have any diagnosis such as autism or ADHD prior to his incarceration, and denied the defense request to remove DR from adult jail.

And DR has remained segregated along with other juveniles in the adult jail ever since. Important to note that the average length of stay in secure juvenile detention such as the Miami Dade Juvenile Detention Center is approximately 15 days, and not more than two years such as DP who is awaiting trial in Adult Court.

More recently, in January 2025, the defense argued DR's jail conditions and lack of an "individualized Education Plan (IEP)" by Miami-Dade County Public School District as reasons to again return DR to juvenile detention.

Instead of falling for and ruling on the defense allegations, the Court cited three of the Court's concerns for DR including: his education time (i.e., DR is currently enrolled in a combination of individualized and group classes), whether DR was receiving enough time outside his cell, and his daily exposure to sunlight, and gave the parties three weeks to collaborate and present proposals for areas where consensus could not be reached.

IMO, the Appellate Opinion per the defendant's petition, filed on Jan 2, 2025, quashing the lower court's 2024 Order for the juvenile to share his "medical mental health, psychological and social work records” with counsel for Miami-Dade County Corrections,” protecting the privacy of the juvenile's patient records, most likely confirmed what the trial Court cited earlier (before the protective Order issued) that there was no learning disability diagnosis for DP before his incarceration.

Looks like he had a lot of rage and bitterness built up. I actually feel badly for the perpetrator here, it does not excuse his actions or behavior. I wonder if some intervention, like therapy would have helped.

The defense team's new theory, that the stepdad did it is such a joke. There is VIDEO of DR standing over his mother's bed with a knife and you see him, from the back for 30 minutes, hunched over her death bed.

And there's video of him and his bloody hands and he took a selfie of his bloody self and then called 911 to confess. But the defense now says 'Hey, maybe the stepdad did it.' Yah, right.

"The incident itself qualifies as a traumatic event, independent of the theories presented by each side, particularly when dealing with the adolescent brain. This requires a longer and more thorough evaluation than usual. A comprehensive evaluation must address previous trauma, which necessitates time and repeated visits," said defense attorneys while asking for a trial date extension.

Blaming it on the stepdad is cruel. He did it. He bragged about it. End of story. They need to stop with the innocence act. Especially when it involves blaming someone who was undoubtedly destroyed by this event.

I can completely understand the anger the perpetrator had. If you have ever grown up, in a single parent home, and then, that parent gets married. This kid had his entire life turned upside down.

No. It does not justify killing his mother. I just have empathy for him. And, seeing the "cringe" picture of him in pink, with the "Step", both touching the victim's belly, I really get where this kid felt so much rage. I wonder if his Biological father was ever part of his life.

Derek's paternal family remains very supportive and close to the defendant. His Dad is career military.

This sounds like a more realistic, believable defense option. I think the jury could easily believe the kid had mental health issues. His actions were so irrational. And senseless.

I did say something about it before and it seemed to be an unpopular opinion then---but I still get weird vibes from the awkwardness and 'intimacy' because of the clothing, and the body language, etc.

It made me feel like there was a competition set up between the 2 males of the house for mom's attention. It's just the vibe I got, not blaming it on Mom or criticising her.

I just think that DR may have felt like he was 'the man of the house' before stepdad barged in. And now there is another child too, also creating competition for him. And that baby empowers the stepdad, making them a little family of 3, with DR on the outside, looking in.

Again, I don't think Mom did anything wrong. I just think that sometimes single moms create a very tight interconnection/bond with their 'only' child for years---but then a new marriage can create a lot of turmoil and upheaval for that same child, who used to be in control of that home.

It is really something to consider when thinking about adding another person into the family. I just felt bad for the kid. And based on his age, I hope he can get treatment and help. Personally, I don't think he should have been charged as an adult.

He showed remarkable restraint, he didn't kill the baby. That, to me, is significant.

I also have a difficult time with him being charged as an adult, for various reasons. However, if he is charged as a minor and found guilty, his sentence is much lighter, correct? (Please correct me if I am wrong. I know nothing about this.) I am very uncomfortable at the thought of him being let out. Perhaps the more strict sentencing guidelines as an adult are what's best, but I think a mental health facility is more appropriate than a prison and I don't know if that is an option.

I agree with much of the above---it is complicated.

A mental health facility would be more appropriate however I have seen so many cases where the violent, unpredictable patient gets on the right medication and is then diagnosed as stable, and is released into the public.

Of course that can cause a lot of turmoil and chaos for the mental health of the patient, and they often stop taking their meds and they can spiral.
