He's the middle man (IMO). From his record, it seems he's done some unsavory things for money... I'm sure he was getting paid.

Is this a felony murder since it includes a break in? I think the laws differ from state to state. But I believe, IF it is a felony murder, anyone involved at all is in for the whole count.

This would be very strange, but if the actual guy who did the murder could say he didn't break in, but was let in (invited in by a family member even though no one was home) maybe the felony falls off and he was able to plea down to murder in the 2nd?
