“The Special Counsel’s report would inform the public about the character and actions of the nation’s highest official, about one of the most significant criminal investigations in American history, and about the Justice Department’s interpretation of the Espionage Act, a statute with broad implications for free speech,” said Scott Wilkens, a Senior Counsel at the Knight Institute. “The First Amendment gives the public a right of access to this report, and the court should publish at least a redacted version of it right away.”

White House staffers were seen today loading around 15 boxes of documents onto the rear of Air Force One.

“The FBl is giving the President his property back that was taken during the unlawful and illegal raids. We are taking possession of the boxes today and loading them onto Air Force One," White House communications director Steven Cheung said in a statement, referring to the classified documents case against Trump that was dropped after he won the presidential election last year.

The White House is suspending the active security clearances of lawyers from the large legal defense firm Covington & Burling who are working with former special counsel Jack Smith, who prosecuted Donald Trump unsuccessfully on behalf of the Justice Department under the Biden administration.

According to a memo released Tuesday by the White House, all executive agencies are to suspend the clearances that may be used by Covington lawyers in private practice as the White House launches a “review and determination of their roles and responsibilities, if any, in the weaponization of the judicial process.”

*“We call on our employers, large American law firms, to defend their colleagues and the legal profession by condemning this rapid purge of ‘partisan actors,’ a group that seems to be synonymous with those the president feels have wronged him,” the letter states. “Our politics and feelings about the industry and its path forward are varied. But we are united in our condemnation of the administration’s intimidation tacts, viewpoint discrimination, and attempts to weaponize the executive [branch] against the rule of law.”

“Our hope was that our employers, some of the most profitable law firms in the world, would lead the way,” the letter says. “That has not yet been the case, but it still very much can be. It is easy to be afraid of being the first to speak. We are removing that barrier; we are speaking. Now it is our employers’ turn.”

*But associates are speaking out, including more than 1,500 associates who have signed an open lettercondemning the Trump administration’s “all-out attack aimed at dismantling rule-of-law norms.”

The associates signed the letter anonymously, providing only their firms and class years. But one organizer behind the letter has stepped forward publicly: Rachel Cohen, a 2022 graduate of Harvard Law School and third-year finance associate in the Chicago office of Skadden.

In a letter shared with everyone at Skadden, she provided “conditional notice” of her resignation, “revocable if the firm comes up with a satisfactory response to the current moment.” She then listed specific steps the firm could take toward that end.

Federal Judge James E. Boasberg has ordered that documents related to the grand jury subpoena of now FBI Director Kash Patel in connection with Jack Smith’s investigation into Trump’s handling of classified information be disclosed back to the Justice Department after the department had trouble finding some of the records.

POLITICO moved for access to the judicial records back in February, and the government has said that some records “can be released in redacted form.”

Justice Department attorney Jeremy S.B. Newman wrote earlier this week that he “attempted to obtain the records at issue from colleagues at the Department of Justice,” but was only able to obtain some version of some of the records because “the people most familiar with these records are no longer at the Department.”

Boasberg signed an order today for the court to disclose the documents to the government in connection with the Patel subpoena.
