According to court records, the next hearing will be held February 26, for three hours. It's a mini trial, called an Arthur hearing. Legal expert Don Pumphrey says it's a common practice.




The main issue discussed was a bond hearing that was scheduled for the February 26th. Adelson's attorneys filed a motion on Friday, arguing she's not a danger or flight risk

It's beyond me how they can say this with a straight face. She:
a) conspired to kill someone
b) discussed suicide with a fellow co-conspirator
c) tried to flee on a one-way ticket to a non-extradition country...

And their argument she's not a flight risk is because she does not have a passport. That's like saying a violent criminal is no longer a threat because they had their knife confiscated. Her means to flee might be now more restricted, but her desire and intent to flee is still there.

I am a soft-hearted person by nature and "sort of" had some sympathy for Donna's "claimed" health issues. I thought about it for several days and finally decided to congratulate Donna on the natural experience and travails of aging. All of these experiences (of aging) were denied for Dan Markel when he was murdered.

100%. I hope she never gets out of a locked facility unless she turns on her daughter in a truthful way, if she was actually involved in planning the murder.

Do we know what is the status of visitation of the children by the Markel grandparents? Is there any?

I think they had a visit a few months back. I seem to recall Ruth M commented it was short but pleasant. Just my impressions, but I get the sense that WA is still playing games and the boys are perhaps disinterested/apathetic towards their paternal grandparents. I guess ultimately they may feel they have to choose sides. Can you have relationships with two sets of grandparents where one set is accusing the other of killing your Dad? Someone has to be in the wrong!

I think they had a visit a few months back. I seem to recall Ruth M commented it was short but pleasant. But the grandparents of the murdered father are not in the wrong demanding visitation.
And one other grandparent is now in jail for murder. Denying the visitation is NOT justifiable at this point in my opinion. I have had only a few cases dealing with grandparent visitation. While my state statutes allow it, courts seem unwilling to honor it.

I meant in the boys eyes. If they think HA and DA had nothing to do with the murder how can they have a relationship with the Markels who have stated they think they were complicit in the murder of their son? And on the flip side, if they believe what the Markels are saying how can they gave a relationship with the Adelsons knowing they killed their Dad?

I think at least one of them has been to see DA in jail which I find quite disappointing. They're not 8 years old any more, they're 15 and 16. Young men. They shouldn't have to be in a situation trying to determine if their grandparents are murderers, but that is the hand that has been dealt them and they need to show some strength of character. The evidence shows DA was involved, they need to start looking at that.

But the boys are mid teens now, and Grandma DA has now been charged with the murder of their father. I'm rather appalled that the court hasn't facilitated more involvement of the other side of the family, given that the custodial mother's side is convicted or facing murder charges.

I don't know. Have the Markels petitioned for visitation? State laws vary greatly on grandparents rights and I don't know what Florida allows. Both states I work in allow it, but to differing degrees. But clearly regular visitation would be possible, not just an occasional thing. But I have also seen that despite the statutes, courts seem to not like wading into grandparents rights.

"A few months back" would have been right before the DA trial was supposed to start, right?

It's been my impression that Wendi permits a visit right before the beginning of each trial, so she can claim on the stand that the Markels are permitted to see their grandkids and have seen them recently.

Two new filings today, including two witness depositions. Assuming these are DA's jail mates that have stories to tell.
