  • Rather than new evidence, it is perhaps an enhancement of some of the existing recordings

The audio feed from the courtroom has been cut after one of the prosecutors used the last name of a juror twice. Judge Everett had instructed everyone to use numbers, which had been effective.

Big win for the defense
  • The Judge dropped a bomb. It seems the motion to suppress Bernhardt testimony is granted
  • It is not clear what will happen to the evidence gathered from the new investigation started by the jailhouse informants

Wow. Judge granted the defense motion to suppress (regarding jailhouse informant). Seems like their arguments about what law enforcement told the informant to do and not do was convincing to him.

Obviously I don’t think the informant was crucial for the state’s case but I wasn’t expecting the defense to get their way with the informant testimony. Interesting. JMOO

Thank you, apeXperience -- I missed it all today. Glad to see that we'll most likely at a minimum hear opening statements tomorrow, Friday, 22 August 2025, at 9 AM EDT.

Wow. I haven't been able to watch today, but I'm looking through these posts. So the defense won that motion. I guess we don't know how problematic or not her testimony might be. Tim Jansen will know who is an alternate and who isn't when they are seated tomorrow so will the other attorney on STS last night, I forget his name. He knew that the guy who was shushing everyone and who seemed intensely in favor of CA at the last trial was an alternate based on where he was sitting.

What do folks here think? I hope men don't have any sympathy for her if it seats more men than women.

Is the other attorney who was on Surviving the Survivor (STS) last night possibly Richard Gabriel, a renowned Jury Consultant and author of "Acquittal"?

Oh, yes, i believe the jury consultant was on. But I think at the last trial Tim J said, based on what that weird guy was doing, he was in the alternate seat. It will be interesting tomorrow how many men/ women he thinks are on the real deliberations.

*Trial set to begin (@ 9am ET) - FL - Daniel Eric Markel (41) (shot to death July 18, 2014, Tallahassee) - *Donna Sue Adelson (64 @ time of crime/73/now 75) arrested by FBI @ Miami Intl. Airport (11/13/23) on out-of-County warrant from Leon County arrest Warrant [#FW23102353] & indicted (11/15/23), charged (11/21/23) & arraigned (12/11/23) with 1st degree murder, conspiracy to commit 1st degree murder & solicitation to commit 1st degree murder. No bond. Held at Miami-Dade County Jail (Turner Guilford Knight Correctional Center. Leon County has 15 days to extradite from Miami-Dade County). Transferred from Miami-Dade to Leon County on 11/20/23. Transferred to Wakulla Detention Facility on 6/6/25. Held without bond (murder), $25K (conspiracy) & $25K (solicitation) on 11/21/23. Plead not guilty. Transferred to Leon County jail on 8/14/25. Leon County
Jury selection began on 8/19/25 & ended on 8/21/25. Jury: 12 jurors & 3 alternates [8 men & 6 women]

8/21/25 Thursday, Jury Selection Day 3: Judge Everett said the pool of prospective jurors has been narrowed to 110 people, who reported on Thursday for a final round of group jury selection. The parties will question 21 potential jurors at a time. Out of the 110 left in the pool, they need 12 plus alternates. They all went thru a list of witnesses to see if those potential jurors know them. Prosecutor Georgia Cappleman questioned potential jurors & than Josh Zelman from defense questioned potential jurors.
*At about 6:30pm: The following jurors have been picked: 1, 2, 5, 23, 11, 14, 25, 27, 28, 29, 31, 34, 35 & 36. Count 8 men & 6 women on the jury. Jurors are to report at 8:45am on Friday. They expect to wrap up each day by 5:30pm.

TJ said in Florida the jury/alternates are based on the number = jurors numbered 1 through 12 are the jurors and jurors numbered 13 and 14 are the alternates. There is nothing further to happen in that regard.

What is more concerning is they only picked 14, not 15 jurors as planned. Not sure why they stopped at 14 or if someone made a mistake. Only having 2 alternates could potentially be problematic, but let's hope we don't lose any in a 2-3 week trial.

If they run out of alternates, the state and defense can agree to a smaller jury (which the defense usually wouldn’t), or theres a mistrial (Heard this addressed on a podcast last night). Also something about the judge delaying the trial to pick more alternates.

Let’s hope we don’t run out!
