FL - FSU Law Professor Dan Markel Murdered by Hitmen *4 Guilty* #26

Luis “King Tato” Rivera is to be released from Federal Prison soon
  • Time flies. Upon completion of 10 years federal imprisonment due to his RICO conviction in 2015, King Tato will be release from Bureau of Prison on 06/30/2025
  • He will be transferred to the custody of the Florida Department of Correction to complete the 7 years reminder of his concurrent 17 years state imprisonment due to his plea bargain in the Dan Markel murder case in 2015
  • This is a bad news for King Tato as his request to stay in federal prison due to fear of Latin King retribution for “rats” (plea bargain) has been denied
  • This is a good news for the Leon County State Attorney’s office as access to King Tato in support of efforts to prosecute the Dan Markel murderers will be easier

Let’s hope they can keep him safe until Florida has gotten through all the cases where they need his testimony. MOO.

Agree that he won't be popular in State of Florida prisons. I suspect his attorney and the SA0 will be negotiating to get him some protection, which could result in him getting shipped to another state, like with CA.

DA defense team files motions (attached) to exclude Stephen Webster and Sara Yousuf as witnesses. The SY filing is very illuminating and you can see why DA team doesn't want her in front of a jury.

DA is no longer in her dreaded Tallahassee; she's been moved to the much smaller Wakulla County Jail in Crawfordville, about 20 miles south of Tallahassee. It is interesting that County Jails can be shopped around by her defense team, looking for more favorable communication policies.

TALLAHASSEE, Fla. (WCTV) - Donna Adelson was transferred from the Leon County Detention Facility to the Wakulla Detention Facility Friday afternoon, according to court records.

Adelson’s defense attorney, Josh Zelman, said the transfer is because of a new LCSO policy regarding inmates’ access to tablets. He said that the policy would have greatly limited Adelson’s ability to communicate with her legal team before next week’s change of venue and her upcoming trial.

“This was the most expeditious way we could ensure that our communications with Donna would not be impeded by the Sheriff’s Department’s new policy, ” Zelman said.

WCTV has also reached out to State Attorney Jack Campbell and lead prosecutor Georgia Cappleman for comment on the jail transfer.

Wow, wow, wow...can't get a softer mattress, but able to move to a facility in another 20 miles away??
(Hmmm...head scratcher.) Just comparing : Leon County jail population (approx. per research) 1219.
Conversely, The Wakulla County Detention Facility houses a population of 270 inmates, including 65 immigration detainees.
It appears the "restriction on communicating" has more to do with DA's current inmate status. IE
"The Leon County Sheriff’s Office community and media relations executive director, Shonda Knight, said the tablet policy was changed within the past month or two, and anyone in protective custody is no longer granted a tablet in their cell. However, she said the jail does not limit inmates’ abilities to speak with their attorneys."
(The article makes the distinction "anyone in protective custody.")

Recalling the "transport" video and trying to figure out if it was a response to DA no longer being
able to control her circumstances and the reality of being prosecuted. I think/feel the reality/conse-
quences of her actions, as she sat in the back of the van, was more than her psyche could handle.
No more "Charlie calls or Xanax" to calm her down anymore. Her notebook entries having an almost
frenetic urgency to keep every waking moment filled with action and purpose, also gone. Heck, I'd be a basket case if my son had just been convicted of murder, my daughter & grandchildren suddenly avoiding me. But not DA! She makes her own plans. Fake & sympathy inducing crying to her son on post conviction phone calls and 30 seconds later...."Harvey, you pack the sunscreen and I'll get the visas." (For the record, Harvey was abandoning his son, too. No honor, huh?)

Webster testified that DM heard DA. On the phone say he was stupid when talking to his kids.

Her attorneys argued that Leon County’s new policy regarding access to tablets hindered their client’s ability to prepare for trial.

Donna has two hearings scheduled this week. On Wednesday, June 11, she has a case management hearing and on Friday, June 13 she has a change of venue request hearing.

Thanks for that "new" date of 6/13! :)

5/5/25 Docket update: Case Management Conference hearing set on 6/11/25 @ 2:30pm.
5/6/25 Docket update: Instructions from Judge set this case for a hearing on 5/9/25 @ 9am. On defendant's motion to take additional depositions. The defendant will be by Zoom.
5/9/25 Update: Some explosive new details were revealed when filings were made public following a brief hearing where Adelson appeared in court to ask a judge to allow her team to redepose some witnesses. Adelson appeared remotely at the hearing via Zoom as her attorneys asked Judge Stephen Everett to grant them permission to redepose several witnesses in the case, including Donna’s estranged son, Robert Adelson. Prosecutors have opposed the request, saying that the witnesses in question have been questioned several times about their expected testimony. They also want to depose Sgt. Chris Corbitt, who testified in Magbanua & Charlie’s trials about the wiretaps & phone records, about the timeline of the investigation. Judge Everett agreed that if the defense has new questions not previously asked or new information, the witnesses can be deposed on that; otherwise, he will take the issue under consideration. Next case management conference hearing on 6/11/25 @ 2:30pm.
5/12/25 Docket update: Order on Defendant's Amended Motion to take additional depositions [for Robert Adelson, Pat Sanford & Chris Corbitt on particular subject of the State's recent investigation]. See post 138, page 7, thread #26 for more info.
5/27/25 Docket update: Defendant's Motion in Limine re testimony of Stephen Webster [who testified in Charles' trial. Adelson wants him excluded] & re testimony of Sara Yousef [close friend of Wendi's]. See post #144, page 8, thread 26 for documents.

So - anything happen at yesterday's hearing? I see she has a motions hearing next on 6/13/25.
Joel Waldman and his cohorts (Jo, Tim, and CEO) on Surviving the Survivor provide a real-time narrative and commentary afterwards — apparently the court’s TV wasn’t working.

Replying to my own post on STS (above, 0:00 - 24:26): Attorney Tim Jansen (a regular on podcast) has an associate in the courtroom reporting back to him because the official pool camera isn’t on. Defense asking again for more discovery time. Donna is on Zoom. Stephen Everett is still the judge.

“… the judge goes, well, you need to specifically tell me what and why you need to extend the discovery deadline and make it specific. And then they moved over to the hearing on Friday for the change of venue where they're going to provide a flash drive to the to the judge with all their exhibits, newspapers….

“… the judge grants [a] motion for judicial notice having to do with podcast broadcast news articles, which Josh Dellman said is already marked and included in a flash drive that he plans to give over on Friday.”

Bottom line, the way I understood it, right now defense isn’t asking for a continuance, but attorney Jo Petuto (regular guest) says she would not be surprised if that comes up in June 13 hearing or even next week. Friday’s hearing scheduled for 2-1/2 hours. This podcast is not as long as most.

She is probably checking the travel websites for countries with no extradition. Is WCJ really a secure facility? I was there once,,,, for lunch. Yup they have a dining room for county employees and guests.
