FL - FSU Law Professor Dan Markel Murdered by Hitmen-Donna Adelson Upcoming Trial - *5 Guilty* #28

It was strange how Dave A. tried to call Tamara out on her comment that she purchased a gun the next day after she saw Harvey and Donnas at Wendi’s, saying it takes time to get a gun unless you get it illegally. He must have some beef with her to do that. It was uncalled for IMO. Basically calling her a liar. Showed his true colors imo.

She said that she bought a gun the next day. Meaning paid for it. Not that she took delivery immediately. A lawyer should know how to parse English sentences literally and avoid extrapolation.

You can go and buy a gun, and take it with you. I've bought in under an hour. All they do is run a background check. Legit stores.

Yeah what was THAT about?? Dave The Prosecutor came out. I don’t think he was saying she had to have bought it illegally but he was definitely being skeptical of her story.

Don’t forget he started out by saying “didn’t you convert to Judaism? But I guess when you need to speak to a priest you need a priest.”

Haha!

I don’t know much about her. It seemed she was pretty close not to just Dan but the Adelsons as well. She spent a lot of time with them. I’m guessing they saw her interview with Isom and that’s where “Enemy No.1” comment came from.

Talked to a priest, bought a gun, and moved has a pretty cinematic beat to it! Or a country song. I don’t know what to make of it. Adults with 2 small children can’t just uproot their lives willy nilly.

Yep. The Adelsons probably thought Tally was a hillbilly backwater filled with poorly educated hicks. Maybe they thought the trial would be like in the movie "My Cousin Vinny." (That's actually one of my faves.) Boy, were they ever wrong. Although it took a while, TPD and the prosecution dotted all their i's and crossed all their t's.
I've said this before. Tallahassee and surrounding area in the Big Bend of Florida has generational wealth, huge farm operations on hundreds of acres of land plus the academia. It is a capital city. Some of these backwater boys have more money than the slimy As have ever or will have. That's their problem. They and their arrogant circle think they are special, when in fact they are pretty low rent.

One thing that’s stood out to me is that it’s not typical for an impact statement to be made under oath at sentencing. And it’s also rare for a judge to swear in a defendant who wants to make a statement at their sentencing. It’s not testimony. It’s not evidence. I want to say, conservatively, in at least half the trials I’ve seen it’s unsworn. The judge just asks the defendant if they want to say something and they just go from there without the oath. And I’ve never seen a prosecutor cross examine a defendant’s pre-sentencing statement. Clearly, Florida law supports this and it’s just Judge Everett’s preference.

I may be being too optimistic but his sworn statement could be used against him when it's his turn to be tried for the murder of Dan Markel. JMOO

This episode also highlights that there is indeed additional, non-public information about incriminating statements made by WA and co-conspirators. Stay tuned indeed. I look forward to the future contortions that will be engaged in to explain this away or minimize it.
Georgia stated according to the Tallahassee Democrat that Donna helped her.

What a burden those boys are saddled with that despicable last name. Surely it is infamous and they hear things.

I’m pretty sure he hinted that at that. I’ll double check.

Dave A. Comment (I probably shouldn’t have used the word “illegal” but thats what came to mind hearing this).

“ Also, I thought there was a waiting period. Well, I don’t have to ask where she bought the gun, But if you buy from a licensed gun dealer, there’s a waiting period in Florida. You can get it immediately from a private sale or a gun show (we know she didn't go to a gun show the next day) ..so UH, I won’t ask those questions” (then he laughed).

The way I hear it (and I just heard it again), it was a bit snarky and challenging to her comment about getting a gun the NEXT day. And what is a private sale? Like LR in Miami? :)

PS The pediatrician’s office calling Webster a couple of days after Wendi left to Miami- and Webster calling Isom. That was interesting. Why would a pediatricians office call an attorney? Perhaps they were trying to call DM and somehow Dans calls were rerouted to Webster?
Wendi was changing the pediatrician from Tallahassee to Miami.
Perhaps Dan needed to approve?

Kind of conflicts with her testimony of just grabbing an overnight with some swim suits for the boys, thinking she was going back…

I think your interpretation is a bit off on this. There is a waiting period of 3 days in FL for a gun sale ‘IF” you don’t already have a gun permit – for background checks etc. You can purchase a gun same day legally from a licensed gun dealer if you already have a gun permit OR same day from a private seller (I don’t think you need a permit from a private seller). Dave answered the way he did because of the way Joel framed the question comparing FL gun ‘purchasing’ laws to NY. Everything Dave stated appeared to be factually correct and I didn’t detect any hint of snarkyness nor did I think he was challenging her comment. Take another listen to how Joel framed the question. Also, I’m not about to relisten to her police interview again, but I can swear Tamera mentioned she had a carriers permit – so she likely had a license to carry and, if so, could have bought a gun that day no problem.

KNITPICKER You always pick up on the details. (I thought that was interesting but not too far out of the realm of issues.) I am thinking DM had "many things/rulings/and or agreements" with his ex WA and made it known to daycare, doctor's office etc...ie, who to contact in an emergency, perhaps? I had a case where the coroner actually called our offices to ask us if we knew the name of a deceased's dentist! Since WA could never stop telling everyone & every contact "My ex is making my life miserable." I'd imagine WA had also informed the pediatrician's office of the contentiousness in regards to the children's healthcare, too? (Home situation, stressors and marital status is often noted in medical files.)
I just love finally getting to hear from Tamara D again....one sharp cookie!

What about his comment about her converting to Judaism and seeing a priest? Lol. She corrected him later and said she never converted and he said he got wrong information from “the streets.”

If she already had a permit to carry before all this wouldn’t she already own a gun? If someone goes through the trouble of getting a permit I’d imagine they’d get a gun at the same time.

Yes, you would think if someone had a carriers permit, they also own a gun. In her interview with Isom, there was definitely talk of her having a carrier permit.. I just don’t remember the details.

If you watched the Goldberg’s interview (friends of Wendi and Dan) there was mention of Tamera converting o Judaism. I can’t remember what they said verbatim, but it had to do with a conversation they had with Dan where he had told them she’d likely be willing to convert for Dan. There were hints of a romantic involvement between the two. Its been a long time since I heard their interview, but I recall that (at least according to the Goldberg’s) Dan had expressed either she’d be wiling to convert or that he could easily convince her. I’d be willing to bet this is where Dave heard this ‘on the street’ and either it was a poor attempt at humor or it was foot in the mouth disease.
