In a filing late Friday, Ebron's public defender says Jacksonville Sheriff's Office detectives illegally searched Ebron's cell phone while he was in police custody. They say their data dive went well beyond what Ebron consented to – which police told him would be "GPS stuff." They also argue that Ebron revoked any implicit consent when he repeatedly asked for his phone back, and was denied.

There are a few exceptions, particularly what are called exigent, or emergency circumstances. But Ebron's attorneys contend there was ample time to get a warrant during Ebron's 11 hour police interview. Absent that, they suggest, police should have gotten written consent – like they did when they wanted Ebron's DNA.

In that circumstance, interrogation videos show, detectives took several minutes to inform Ebron of his rights, and to have him sign a consent to search form, before taking a DNA sample.

Attorneys also argue that Ebron's phone, though initially given to police, became an illegal seizure when officers refused to return it. At one point, when he asks for his phone and says he wants to leave, and off screen officer says, "We are keeping the phone."

Many of us knew well before the DNA testing that CB might not be Lonzie's biological father because of Facebook posts by the guy claiming to be the bio-father, so I'm sure CB was aware of the possibility. And probably has been for much longer than we have.

Lonna and Ebron waived their court appearances this morning. Their attorneys attended on their behalf. The judge set December 28 as the final date to file any new motions. The judge also set a hearing for January 6 to hear the motion on the cell phone search. So far no word on what's included in the motion - just the data or all the information? I suspect the attorney wants it all thrown out.

January 7 will be the last pretrial hearing and the trial is scheduled for January 11.

"Acid tabs broski," another person writes. Prosecutors said the messages show that Ebron was buying and selling drugs regularly in the months before Lonzie disappeared. Assistant State Attorney Richard Mantei wrote in an order that Ebron was "on multiple occasions the person charged with the care, custody, and control of the minor children in his care," claiming that Ebron stated he was "running a daycare for strippers."

Attorney Gene Nichols, who is not involved in the case, said the phone records are evidence the state wants and the defense doesn't. The judge has already ruled that all of these messages won't be shown to the jury. But prosecutors have a chance to get some of them admitted as evidence in Ebron's trial.

“If they can establish that at the time he's with the child that he is participating possibly in a drug deal, he is participating in other activities ... that he's not taking care of the child. That is when the judge would decide, 'Yes these should probably come in,'” Nichols said.

Interview with Ebron's parents:

In another [text message from Ebron's mother to Ebron], “You can’t get a smart woman because you couldn’t go toe-to-toe with her intelligence — so stay in your lane. Hang with the ignorant losers.”

“I know that most of the text messages, if not all that I’ve sent him, have been on the right side of God — what a person should tell their kid — the right thing to do,” she said.

Both she and her husband admit their efforts did not have the result they hoped. William Ebron Sr. said he found the content of his son’s text messages that were filled with drug references and apparent sales “shocking and disappointing.”

Slightly OT, the lead prosecutor for the case suffered a stroke and has recovered and is reported to be more energized than ever. Hoping for another 'Christmas miracle' which would be finding little Lonzie.

I've been thinking about Lonzie today and hoping that he will be found soon. He deserves to be laid to rest with dignity.
He deserves justice.

So, I am praying that whoever knows where he is will finally tell police where to find him. And I pray for justice for Lonzie, and all the children who have disappeared or died at the hands of those who should have kept them safe.
